Yes they are legal in New York.

However, her mother lives in another State. Does she not have one either?

Residential garbage disposals were illegal in New York City until 1997.

Not accurate. They were illegal in New York City until 1997. It was never state wide. NYC Building Sups. can still ban them if the don’t think the plumbing is up to snuff.
