Full title: Navy SEAL Eddie Gallagher’s commander defying Trump’s orders, trying to send him ‘back to the brig’: lawyers

The legal team representing Navy SEAL Edward Gallagher is now accusing his commander of undermining orders from President Trump by imposing “unnecessary and punitive restrictions” on the decorated warfighter in hopes to entrap him and get him “remanded back to the brig.”

The blistering allegations against Naval Special Warfare Group 1 Commodore Capt. Matthew D. Rosenbloom were outlined in a 19-page court motion provided to Fox News just 10 days after the commander in chief tweeted that Gallagher will be moved to “less restrictive confinement while he awaits his day in court” on May 28.

Special Operations Chief Gallagher, who is alleged to have killed an injured ISIS prisoner of war in Iraq, amongst other war crimes, was moved out of the brig at U.S. Marine Corps Air Station Miramar in late March after being confined there since September 2018. Gallagher is now being held at another facility in the San Diego-area, but his lawyers are asserting that Rosenbloom is overstepping his bounds, and in their filing late Tuesday asked a military court to remove the “conditions of pretrial restraint unlawfully placed upon” him.

"Despite numerous attempts to bring the illegality of these actions to CAPT Rosenbloom’s attention, in the hopes that he would reverse course, CAPT Rosenbloom has remained intransigent and defiant of both the Orders of the President of the United States and the principles of the Constitution, which he swore to uphold and defend," lawyer Timothy Parlatore wrote in the filing.

Seems reasonable. I have not seen any explanation for why they wanted to keep him in maximum confinement. Is there some underlying information that has not been made public, some threat that they think he poses to even his family?

Some of us have not been following this story closely can somebody please explain without being a smart aleck please I really beg of you. One who is Gallagher ? And what is he accused of? Literally without editorial what is it? who is his Commander?

Below link describes the charges (murder) and the background.

Chief Gallagher was being held in solitary and President Trump reversed that, he's now on base and under the command of Capt. Rosenbloom who I guess is making it tough for him.

His court-martial starts on May 28.

And people putting restrictions on our warfighters as if those warfighters are LEOs in our own countries policing our own streets need a beating.

There’s a whole host of issues and indicators that un-innocent a man that an armchair civilian just isn’t going to see or be able to recognize. So, the warfighter will always be at risk of being hanged by his own because his own is an idiot.

Yes,one would *assume* that that was the case but I noticed nothing in this piece indicating that one was issued.And although I only achieved that lofty rank of SP5 during my stellar Army career it's hard for me to picture an O-6 disobeying a clear and unambiguous order from *anyone* above him in the chain of command.
