Notice that they have no actual reason (e.g. specific investigation) stated to obtain them. They just want them so they can fish through them. I don't see much chance of this particular request being deemed valid under the law (must have a reason for obtaining them). And the law itself might be tossed on 4th Amendment grounds. It almost looks to me like Neal created his request in a way that would get it tossed.
Interesting thought, the idea he may have crafted it to fail.
