A transgender prisoner says shell pursue her fight to have Texas pay for gender reassignment surgery after suffering a loss at the 5th U.S. Circuit Court of Appeals.
A lawyer for Vanessa Lynn Gibson, born as Scott Lynn Gibson, says shell ask the full 5th Circuit to rehear the case after a three-judge panel upheld the states policy that denies funding for the reassignment surgery.
The state will cover hormone and mental health care treatment.
In a 2-1 ruling published Friday, the court said refusing to facilitate the surgery does not constitute cruel and unusual punishment as defined by the Eighth Amendment.
Under established precedent, it can be cruel and unusual punishment to deny essential medical care to an inmate. But that does not mean prisons must provide whatever care an inmate wants, wrote Judge James C. Ho, a Trump-appointee, in the 23-page opinion.

The only help I could see that might be helpful is intensive mental health treatment. They are mentally ill.

On to the next higher court. Or,perhaps,a similar case will be heard by the 9th Circus. No mystery how *they'd* rule.

However it does appear that the lobotomy was tossed in for free as part the journalism package.

No doubt about it and the LGBT movement does a disservice to them.

Hope the Supreme Court rules on this so it’s law throughout the land, and not something the Ninth Circuit can contradict.

Even the expensive, ongoing hormone treatment is too much.
It is purely elective.

On the other hand, allowing hormone "therapy" is in some sense an admission of some sort of legitimacy to transsexualism.
So there's an inconsistency that could make the ruling vulnerable to be overturned on appeal.

If the 9th circus rules contrarily, the Supremes will then need to take the case to clarify the law!

So, how was it that Bradley (’chelsea’) Manning was in fed pen. or was it military pen— and got one? So now, does this mean he/she-it has to pay the cost back. Ridiculous any fed money ever going for this “choice” without years of psych workup.
