What is the specific (argued) constitutional principle that allows one to be sentenced to life in prison (or remain in prison for life) but not be sentenced to death (or put to death if already sentenced)?

There fixed it, but, it's not like that's breaking news.

I know I know, better Roberts than Ruth on the court. He's probably the least liberal of the liberals on the court, which doesn't necessarily translate into the least damaging.

Important for conservatives to keep in mind we have only kind-of-a-tiny-majority and often not on the things that matter most. We don't really have a majority until and unless Ruth gets replaced.

Guess the next step will be to release him since he can’t remember the crime with the rationale that if he can’t remember his crime then he can’t remember why he is being punished. He should have been put to death years ago for a crime that occurred in 1985. Instead he is still alive after almost 19 years while his victim had no such reprieve. That is not justice. Also look for a lot of other inmates convicted of murder to start claiming they can’t remember their crime.

It’s a process issue regarding legal mental competency.

We have checks and balances for a reason, to avoid harming the innocent even if it means some of the guilty escape justice.

I don’t have a problem with that.

Vernon Madison murdered a policeman in 1985. Why is a 34 year reprieve a reason to let him off now? Where does the Constitution say that duly convicted murderers have to rationally understand their crime and punishment? (That is the court’s excuse). The crime remains the same. The perpetrator remains the same. The punishment, though unjustly delayed, must remain the same. Is the guy now a productive, safe citizen ready to be released into society?
