Congress believes the Pentagon has $21 billion in unobligated military construction fundingmoney that has been appropriated by the legislature and set aside for specific projects but not yet issuedthat the president could use to build the wall over objections from Congress, according to two congressional aides.
The $21 billion comes from funds in the Defense Departments budget that were appropriated for various military construction projects over the last five years but not yet spent, the aides said. The largest chunk, $10 billion, is from the appropriation for fiscal year 2019, which Congress just passed and is largely unspent. The rest, about $11 billion, comes from the previous four years.

I think Trump will get the loose money to build it. However, after all the legal battles, if we have half the wall up in 2024, I’d be happy. This is going to be a slow process.

Higher priority was to get SOME money approved by congress and signed by POTUS to make it law. What that does is it nullifies Pelosi-Schumer argument that wall is immoral. Pelosi has now supported building the immoral wall with the $1.3 Billion approved by law.

I am not sure about the legal intricacies of the whole issue about funds for the wall. I will defer to the judgement of PDJT, over mine, yours or anyone else on this forum. We just do not have all the information and legal resources the president has.
I keep reminding everyone Trump was not elected dictator and there are no absolute victories in DC. It is always a Hodge- podge sausage making.

SCOTUS can accept a "petition for certiorari before judgment" which permits the Court to expedite a case pending before a United States court of appeals by accepting the case for review before the appellate court has decided it. However, Supreme Court Rule 11 provides that a case may be taken by the Court before judgment in a lower court "only upon a showing that the case is of such imperative public importance as to justify deviation from normal appellate practice and to require immediate determination in this Court."
I think National Defense would certainly qualify for "of such imperative public importanance."
This was done in Bush v. Gore, 531 U.S. 98 (2000) in 2000. From the ruling "Petitioners, the Republican candidates for President and Vice President who had been certified as the winners in Florida, filed an emergency application for a stay of this mandate. On December 9, this Court granted the stay application, treated it as a petition for a writ of certiorari, and granted certiorari."

Like I said, his advisors ARE MORONS and they’re doing tremendous damage to the office of the Presidency by ceding power to the courts(which they don’t have)
So if the Chicoms were staging south of the border for an invasion(tanks, etc., millions of men), would PDJT have to wait for the courts to give him a green light before he could act?(build fortifications, use the military...protect America?) /oxy sarc
