Immigration Landmines in the Funding Bill

The text of the funding bill was released last night/this morning, and lawmakers are expected to vote on the 1,169-page measure as early as this evening. The bill is disappointing in many respects, but if it had been as advertised earlier, it might have been tolerable.

But my fears that senators Durbin and Leahy would trick the Republican conferees (none of whom knows the first thing about immigration policy) were realized. Standing out among the many distasteful provisions are two poison pills that I hope the Republican committee members either didn’t know about or didn’t understand.

The first regards the fence. I’m not fence-first guy, but physical barriers really are needed on some parts of the border, and the president has been flexible on this in the face of implacable Democratic opposition. Thus the news that the Dems agreed to $1.375 billion for the construction of “primary pedestrian fencing” (i.e., high barriers, not the low ones intended simply to stop vehicles, in places where there’s none now) seemed like a win.

It’s not. That’s because the bill allows the fencing to be built only in the Rio Grande Valley Sector in South Texas. It’s surely needed there, but real barriers are also needed elsewhere, such as the parts of the Arizona or New Mexico borders where there’s only vehicle fencing.

But the Democrats had a reason for this limitation...

I hope President Trump doesn’t sign this BS bill that no one with a brain has read. Congress-losers despise the American Citizen. We are chumps for not demanding they be arrested, taken to court and convicted of their crimes against American Citizens and civil society. Same old BS from these rotten losers.

Actual landmines I thought would be more fun anyway. No border walls just 100 yards or so of landmines with bleachers where you could sit, watch the fun and bet on how far they get.

The chief GOP negotiator for the Senate was 84 year old Richard Shelby of Alabama who has served in the Senate for 34 years. If you are serious about negotiating you send a pit bull, not a tired old lap dog. McConnell sent the lap dog and got the desired results.

Steve Scalise just stated on Martha MacCallum’s show that mayors will only have input. Homeland Security still has final say.

I don’t know what 224a is. I’m guess some subsection of the bill. I haven’t read the bill.

There is apparently a provision that gives mayors of border cities veto power over wall construction.

The bill also does not increase the detention space. So when centers are full, the migrants get released. So catch and release will continue.

They also put limitation on who ICE can arrest.

This bill is going to make illegal immigration even worse no matter what happens with the wall.

I’m not sure about the effect of the limiting beds. I thought ICE and BHP were releasing the illegals back into Mexico to await their asylum hearings.

I don't agree. To do that the courts would have to decide, without due process, that there is no emergency and that the President has not authority to declare an emergency and to act on it. I don't think that they will do that. If so, they would have done so in 2000 and we would have had 8 years of the Gore Administration.

Democrats wrote that monster, and we’re rushing it through on their word. This is not good. I say don’t sign it until every republican lawyer in the white house can go through it line by line. You know it’s loaded with stuff that will hamstring President Trump and his agenda.

The beauty is that the President’s emergency declaration circumvents all the restrictions in this Democrat bill. And emergency declarations have no expiration date. We are still operating under W Bush’s emergency declaration calling for the TSA at airports, and several of Obama’s 13 emergency declarations are still in effect. So Pres. Trump can keep building the wall till he’s out of office in 2024 and then Pres.Pence can finish it.
