SANTA FE Procedural warfare erupted on the floor of the state House late Friday as legislative staffers locked doors to the chamber and chased down missing lawmakers before Democrats pushed through legislation that would require a background check on nearly every firearm sale in New Mexico.
Chaos ensued as the proposal, House Bill 8, passed on a 41-25 vote. House Bill 8 would make it a crime to sell a firearm without conducting a background check, with certain exceptions. Sales between two law-enforcement officers, for example, would be exempt from the requirement.
Federally licensed firearms dealers already must conduct background checks. But the proposal would expand the requirement to other sales such as a transaction between two private individuals.
Supporters said people wanting to sell and buy a gun would meet at a licensed dealer who would do the background check.
Opponents, in turn, said people in rural areas might have to make lengthy drives to reach a licensed dealer.
The proposal now heads over to the Senate, where a similar proposal has already advanced to the floor after clearing two committees.
House Bill 8 passed the House largely along party lines, with Democrats in favor and Republicans opposed.
The House late Friday also voted 37-28 to pass House Bill 87, which would prohibit someone convicted of battery on a household member among certain other crimes from having a firearm. That measure, sponsored in the House by Rep. Deborah Armstrong, D-Albuquerque, now moves on to the Senate.
A third proposal, not yet acted on by the full House, would allow family members or police to seek court orders to take guns temporarily from someone they believe is an immediate threat.

NM state police have a pretty bad reputation. I think they like to SWAT. Pretty bad if they start enforcing this type of of law.

Wasn’t it in NM that the state patrol arrested some guy, then ran him through several enemas and other medical procedures on suspicion of drugs, then tried to make him pay for their violating him, AFTER there was nothing found?

Anything purchased through a firearms dealer requires a NICS (background) check. Are you saying PA already requires a check on private handgun sales?
The conservative areas of NM don’t have enough voters. ABQ & Sante Fe and the hippies have the controlling votes in NM.
We already have galactic background checks, right? What date did that go into effect?
I can sell 1mm long gun sales, privately, with a simple Sales Receipt in MS-Word, which I designed.
To buy/sell a handgun in PA, requires an FFL and BATF Form to get a background check/transfer done. Sure, you can sell a handgun privately, but if you get caught, enjoy the orange jumpsuit.

Only if done legally. Buying a handgun privately is illegal and off-the books. But if you get caught, you’re in a world-of-hurt.

The proposed language in HB-8 would make it a misdemeanor.

A lot of the artsy-fartsy folks come from the east coast. Also, a lot of the young voters have been indoctrinated by 12 years or 16 years of liberal education so they now vote “progressive.” Then there are the chronically poor (lots of Native Americans and poorer Hispanics) and they vote Democrat for the welfare and medicare benefits; finally the latter vote for the name only (Hispanic name likely worth 10-15 points).

surprised about is they put the cart
before the horse and haven’t proposed
registration laws. Without registration,
this law is totally unenforceable. About
the only way to catch someone making a
private sale is the buyer or seller
would have to be undercover law

purchased a weapon from someone I
didn’t know,
I would imagine the vast majority of private sales are to people you know. I've made a few 'off books' purchases myself, and that was the case for me. That's one reason these laws are so stupid. (there are others of course)
