‘Acting’ are frequently moved to the permanent job. They have to step aside from the ‘Acting’ job to be nominated.
Whitaker was appointed under the Federal Vacancies Reform Act. He CANNOT become the permanent AG. The object of appointing him under the FVRA was to have him hold the seat until a Permanent AG can be seated. Can’t have it both ways.
