Rao’s Judiciary Committee hearing is Tuesday, February 5. Senate Democrats and liberal interest groups are trying to attack Rao in order to damage her prospects for a future Supreme Court nomination and to serve as a warning that if she is nominated, they will Bork and Kavanaugh her.
After her nomination, Democrats immediately spread falsehoods about her record and views, something we noted was part of an overall Democrat strategy to slow down the judicial nomination train:...
So, to sum up: A liberal group dumped oppo to the media, the media played it up, then the liberal group cited those media reports to proclaim the nominee disqualified.
Ms. Rao’s sins aren’t that she was inflammatory but that she is conservative. Ms. Rao took a dim view of racial preferences in a piece about the great African-American scholar, Thomas Sowell. She also wrote that progressives preach tolerance but too often don’t practice it. Q.E.D. Some of her writing is infelicitous or sophomoric, but none of it is relevant to how she might rule as a 45-year-old judge with adult life experience….
The irony is that the left is making Ms. Rao a political target precisely because she’s a woman of color. She’s the daughter of immigrants who landed in Detroit from India in a January 1972 snowstorm with little money and no winter coats, as she told Congress in 2017. The left is afraid she might someday be a Supreme Court nominee.
The Rao nomination will be a test of whether Republicans will permit a completely qualified nominee to be Borked and Kavanaughed, again.

The Senate should not waste its time with hearings until there is a Democrat on the committee willing to do something other than act in entirely bad faith from start to finish.
Just hold a vote and move on. No Democratic votes will be available under any circumstances, so there’s no point in even discussing the nominations with them.
There didn’t used to be ‘hearings’, the Senate just voted straight up or down. NOW IT’S A FREAKING CIRCUS!........................

Yeah I’m in sync with that. There is absolutely no point in hearings that cannot under any conceivable circumstances change the outcome of the final vote.
And she’s a daughter of immigrants, a woman of color!
That headline was baffling until I realized Kavanaugh had been verbed.

You know . . . a hearing . . . that is where we get to hear the Rats tell how evil the nominee is.
No need to be alarmed about the nominee unless they present hard evidence that the nominee is a mass murderer.

Dwarf-tossing has been banned in some US states and parts of France for offending human dignity, and a Nov. 16 post on Mother Jones by Stephanie Mencimer called Rao a “staunch defender” of this pastime: “Rao considers these laws an affront to individual liberty that fails to recognize the right of the dwarf to be tossed,” Mencimer writes.
Rao has argued in two law review articles and a post on the conservative law blog Volokh Conspiracy in 2011 that banning dwarf-tossing is problematic because it’s the kind of legal situation that pits cultural values against constitutional rights. Viewed in that light, she didn’t write a defense of the dwarf’s right to be tossed so much as a defense of an individual’s liberty to make personal determinations of dignity, according to Weissmann, which extends far beyond the narrow issue of throwing little people around for sport.
Rao’s writings pointed to the fact that it was a little person who challenged the ban by mayors in France because it robbed him of his ability to earn a living, and that earning his way allowed him to lead a dignified life. The concept of “human dignity” in the law, which Rao says is a value judgment premised on culture, interfered with personal liberty protections that are constitutionally enshrined.

Bret Kavanaugh has showed the world that brains beat bullies. He answered each question brilliantly. If you can keep your head you can beat the Democrats their arguments are weak and have failed in the past.
