New York’s leaders are pushing an extreme pro-abortion bill that will strip away all protections for unborn babies and some for mothers, too.
The “Reproductive Health Act” redefines a “person” as “a human being who has been born and is alive,” according to Breitbart.The state bill also describes abortion as a “fundamental right.”
This language will allow unborn babies to be aborted for basically any reason up to birth in New York. It looks like it will pass in the new Democrat-controlled state legislature this winter. Gov. Andrew Cuomo has threatened to hold up the budget until it does.
The legislation goes beyond Roe v. Wade, allowing abortions even when the Supreme Court has said states may regulate them, according to the pro-life leaders. Late-term abortions, which currently are illegal in New York, would be allowed, and non doctors would be allowed to perform them...

Yes. Someday there will be cultural war crime trials much like the Nuremburg trials. The evil degenerates who vote for this will be convicted of crimes against humanity.
Removing a fetus from the womb is technically a “birth”. So if the woman is not going to hold the fetus in her womb for the rest of her life, aborting, by removal of the fetus, will be illegal per the new law, if enacted.
Before you call for us all to burn, kindly keep in mind that Cuomo only won about a fourth on NYS’s counties.
In any case, at least some of this is in direct contravention of the BIAPA. And if that has not been repealed, then federal law trumps state law and infanticide is still illegal.

Obama didn’t even believe being born alive made you a person and shielded hospitals that left such babies to die in linen closets.

30 seconds before medically defined birth you stab the full term baby to death while still in the mother and that’s just fine. Nothing to see here. Move along citizen.
That would be a way to have the law struck down by the Supreme Court as a violation of "equal protection".
If New York can, by law, specify that a fetus does not become a person until actual birth, then could not any other state enact a law making a fetus a person upon conception. When a fetus becomes a person determines when they acquire constitutional protection under the fifth amendment. I believe Roe v Wade avoided specifying a date to get around that issue.

The article is somewhat inaccurate. The section that says a baby is not a human until a live birth is specifically under the definition of abortion. I still thinks it is problematic since murder is defined as:
§ 6. Section 125.00 of the penal law is amended to read as follows:
§ 125.00 Homicide defined.
Homicide means conduct which causes the death of a person [or an unborn child with which a female has been pregnant for more than twenty-four weeks] under circumstances constituting murder, manslaughter in
the first degree, manslaughter in the second degree, OR criminally negligent homicide[,abortion in the first degree or self-abortion in the first degree].
The abortion section is:
§ 7. The section heading, opening paragraph and subdivision 1 of section 125.05 of the penal law are amended to read as follows:
Homicide[, abortion] and related offenses; definitions of terms]
DEFINITION.
The following [definitions are] DEFINITION IS applicable to this article:
[1.] “Person,” when referring to the victim of a homicide, means a human being who has been born and is alive.
Two definition of homicide may become a issue in court with a good lawyer.

Before birth, the ductus arteriosus and foramen ovale are open.
After birth, both are closed.
Those are about the only physical changes between the fetus and baby.

Does the law clarify exactly how much of the baby has to out before it is murder?
