Donald Trump said on Friday that he does not plan to declare a national emergency a day after suggesting he would probably do so.
Speaking at a cabinet meeting over the government shutdown and the border wall, Trump said: What were not looking to do right now is national emergency.
The president instead urged Democrats to come back and vote in Congress in a bid to end the government shutdown.
Trump insisted he had the right to declare an emergency, but said: Im not going to do it so fast, according to a White House pool reporter.

Here is an extract from USNORTHCOM’s published position (http://www.northcom.mil/Newsroom/Fact-Sheets/Article-View/Article/563993/the-posse-comitatus-act/). NORTHCOM is the Unified Command within DoD, that exercises command and control of US Military forces withing the Continental United States. They cite DODD 5525.5 as an implementing regulation within DoD, but the Departments of the Army and Navy also have their own implementing regulations.
As required by Title 10 USC, Section 375 the secretary of defense issued Department of Defense Directive 5525.5, which precludes members of the Army, Navy, Air Force, or Marine Corps from direct participation in a search, seizure, arrest, or other similar activity unless participation in such activity by such member is otherwise authorized by law.
The PCA generally prohibits U.S. military personnel from direct participation in law enforcement activities. Some of those law enforcement activities would include interdicting vehicles, vessels, and aircraft; conducting surveillance, searches, pursuit and seizures; or making arrests on behalf of civilian law enforcement authorities. Prohibiting direct military involvement in law enforcement is in keeping with long-standing U.S. law and policy limiting the militarys role in domestic affairs.
The United States Congress has enacted a number of exceptions to the PCA that allow the military, in certain situations, to assist civilian law enforcement agencies in enforcing the laws of the U.S. The most common example is counterdrug assistance (Title 10 USC, Sections 371-381). Other examples include:
The Insurrection Act (Title 10 USC, Sections 331-335). This act allows the president to use U.S. military personnel at the request of a state legislature or governor to suppress insurrections. It also allows the president to use federal troops to enforce federal laws when rebellion against the authority of the U.S. makes it impracticable to enforce the laws of the U.S.
Assistance in the case of crimes involving nuclear materials (Title 18 USC, Section 831). This statute permits DoD personnel to assist the Justice Department in enforcing prohibitions regarding nuclear materials, when the attorney general and the secretary of defense jointly determine that an emergency situation exists that poses a serious threat to U.S. interests and is beyond the capability of civilian law enforcement agencies.
Emergency situations involving chemical or biological weapons of mass destruction (Title 10 USC, Section 382). It all BS. Soldiers throughout history have been paroling borders since there were borders and soldiers, i.e. for about 5,000 years or so. Apprehending a foreign national is not harming US citizens an is in the spirit of those regs.
We are in a lawless time so our side needs to use this to our advantage.

Eisenhower did not set precedent - the quelling of domestic violence exception has been invoked many times before and since.

If this drags out much longer, Dems may actually begin to do a more effective job of pointing out that over 600 miles of barrier/wall have already been built; terrorists come in from Canada and by plane, not Mexico; only 1 in 5 vehicles allowed across the border is searched; shipping and shipping containers are insufficiently searched; 3/4 million illegals are visa overstays like some of the 9/11 attackers; and other important issues not addressed by $5 billion for a wall/fence.
Also, since Trump is not a politician, he was no doubt informed that if he does this, future administrations could do something he would not like as Truman did regarding steel around WW2.
The Chinese definitely bear watching. Blaming everything on Soros is too easy. And, of course, it is not possible that buddy Putin could possibly be up to anything not in our interest.
Back in the 1960s and ‘70s, there was an NGO helping labor unions in Latin America build worker housing, setting up cooperatives, etc. in a bid to undercut communist subversion there. Some said this NGO was a CIA front. At any rate, one of the places where housing was built was San Pedro Sula. I think something like 2,000 units. There may also have been worker education. Was this before Soros’ time?

Look, I have no problem with U. S. investors helping to build reasonable housing for people anywhere. It does need to be profitable for them.
Not everyone needs to have facilities that are as advanced as ours. I don’t mean that to sound elitist, but not everyone can afford housing like ours.
Build what makes sense there, something folks can afford, even if it is very simple. Keep them warm and dry.
