The United States of America is well past the point where we need to worry about setting a new precedent. We’re at the point where my primary concern is avoiding the precedent set during 1861-1865. President Trump has to accomplish as much as possible toward restoring the rule of law, returning us to constitutional government, and protecting our borders, or we are very likely to face a catastrophe on a scale that few Americans today can imagine. So long as his actions are within existing law or within the boundaries set by the Constitution as written, potential later interpretations of a precedent should not be a concern at all.
Is Kilmeade a supporter of all our presidential-driven foreign wars? In Syria, Afghanistan, Iraq? Ill bet he is. But presidential action to secure our own border is a problem?
An EO banning conservative websites would be a violation of the first amendment. Banning citizens of a hostile foreign power from entering our country is not.
He always looks like he’s ticked off about something. I get the feeling he doesn’t get along that well with the other two co-hosts or maybe they don’t have much in common???

The simple fact that Kilmeade is missing is that a future liberal/socialist/communist President WILL declare something an emergency on which he/she/it wants to spend a lot of money - bet on it, it WILL happen. But the only thing that Trump declaring a national emergency over the border now will do is give that future President a fig leaf of an excuse that will be used by the media as a talking point for about 2 days.
IOW, Trump shouldn’t listen to Kilmeade, however well-intentioned Brian may be.
I don’t think he would.
If he can do it for this purpose, than a Democrat President can do it for whatever.
If Congress doesn’t want him declaring an emergency over something like this, then they need to tighten up the law that allows for declaring national emergencies and spending money under them.
Noting that the states have never amended the Constitution to give the feds the specific power to police the environment, patriots need to do the following to limit the president's national emergency powers.
Patriots need to elect a patriot Congress in the 2020 elections that will amend the presidents national emergency powers to make the presidents emergency actions compliant with Congresss constitutional Article I, Section 8-limited powers.
Also, regarding the border wall and Democratic politically global warming, note that the wall will put a stop to the carbon footprints that undocumented Democrats are bringing into the country.

The rules on appointees were good ones in a sane world, but were diminished first to disallow opposition, and then to get around misbehavior. Unfortunately, changing them didn’t diminish misbehavior, but rather simply changed the bar as to how much was required in order to affect things.
We keep breaking things, and once broken, it is very difficult to re-form them again. While there have been many issues over the long years, Bill Clinton introduced many tactics and behaviors into politics and Presidential processes that once the barriers were breached are now part of the common discourse and executions of power.
