The Act must be enforced by existing laws of the institutions involved, such as Border Patrol, ICE, and State Law Enforcement. This will take priority over Sanctuary Laws, which of course will meet with inevitable Court challenges from Federal District and State Courts.
The purpose for the Emergency Act must meet a standard that there is a threat to health or national security from within and outside our borders. There are currently 21 active National Emergencies called over the years, including H1N1 Swine Flu. It is beyond reason that the National Security is NOT in peril by conditions on the Southern border.
So! It is time. Our president must leave it all on the field, when he receives the inevitable, well shopped Federal District Court Restraining order to "cease and desist"
The President must advise the Court that he DOES have Constitutional authority and the reason to call a National Emergency, and the Court will have to show evidence that he does not have it, or the National, threat to do so.
Then, announce to the Nation and the Court that in the meantime, as Commander in Chief he has ordered the Army Corps of Engineers To build the wall, and they have begun.
Yes, all bloody hell will break loose, but it is well past time that it does and we support the President with all we have! There IS a separation of government and its TIME for the Democrat Party to stop using the Federal Courts as an operational arm of their mob.
It is time to free our President to do what is required to save this Country, and to support him with everything we have!
The President will address the Nation from the southern border this Thursday Jan, 10. This could be it. Let's give him our prayers, letter, calls, and e-mail we can to support him.

If he invokes the act its because it is a national emergency and we are acting in time to do something about it. Did you see the elections in CA? Lot’s of red flipped to blue, and not because those red ones lost, but because ILLEGALS WERE BALLOT HARVESTING.

(b) When a decision is made to undertake military construction projects authorized by this section, the Secretary of Defense shall notify, in an electronic medium pursuant to section 480 of this title, the appropriate committees of Congress of the decision and of the estimated cost of the construction projects, including the cost of any real estate action pertaining to those construction projects.
(c) The authority described in subsection (a) shall terminate with respect to any war or national emergency at the end of the war or national emergency.”

So, the 2016 population of Texas was 27 million. What you’re saying is that having illegals such that it exceeds the second most populous state in the country isn’t an emergency?
California has 39 million people.
Nobody, of course, is going to put that into perspective but illegals represent about 40 electoral votes.

I got lots of puzzled looks but no definitive answer.
I then walked to the border. I talked to some Border Patrol officers. They said it was just like the last eight years of the Obama administration.
