Technically, no, she may not. Just as Kavanaugh may not rule on cases he was not seated for that were heard after Kennedy resigned.

Kennedy resigned July 31 and Kavanaugh was sworn in on October 6th. He missed six cases in the first week of October.

Kavanaugh wasn’t sworn in on the first cases due to the senate circus. That looks like it might make an apples and oranges argument.
