The question is whether ICE agents have the authority under federal law to be inside a state facility without invitation from the state authority? If the answer is “no”, this sheriff is blowing smoke to seem tough and anti-Trump.
If ICE agents are outside the jail in a public place and place a person under arrest upon their release, it seems that the sheriff may not interfere with the carrying out of their lawful duties. It seems any physical interference by the sheriff in the lawful actions of the federal agents would subject the sheriff to federal charges. Usually different agencies respect the jurisdiction of the other.
The leftist game is no wall to keep them out, no federal action to prosecute illegal entry once they are in. This is beyond irony because for decades the left has been trying to federalize everything because local officials historically have stereotyped by them as backwards, prejudice bigots who selectively target people. They have used many federal judges to go after local authorities and impose their will on states. The left didn’t have this federal problem with BHO, who selectively and tepidly enforced immigration laws. Now they are using local control as a way to further their agenda, until they get back the reins of federal power - and then don’t expect them to play nice and respect local control that doesn’t fit their politics. Seems like it comes directly from the communist playbook. If they hate this country so much, we don’t have to let them destroy it; they don’t own this country, despite what they think. I wish more in the GOPe would see the big picture, instead of jockeying for position at some politician’s funeral.

Mecklenburg County Sheriff Garry McFadden’s decision to end a jail immigration program “is an open invitation to aliens who commit criminal offenses,” an official with U.S. Immigration and Customs Enforcement said Thursday night — adding that “residents should expect a more visible ICE presence in Charlotte, as ICE will now have no choice but to conduct more at-large arrests in local neighborhoods and at worksites.”
That change “will inevitably result in additional collateral arrests instead of arrests at the jail where enforcement is safer for everyone involved,” said ICE Atlanta Field Office Director Sean Gallagher, in a statement emailed to the Charlotte Observer Thursday.
