Judge Emmet Sullivan of the U.S. District Court in Washington ruled the harsher Justice Department policies ordered by former U.S. Attorney General Jeff Sessions were "arbitrary, capricious and in violation of the immigration laws."Because "it is the will of Congress — not the whims of the Executive—that determines the standard for expedited removal, the Court finds that those policies are unlawful," Sullivan wrote in his 107-page decision.
He permanently blocked the government "from continuing to apply those policies and from removing plaintiffs who are currently in the United States without first providing credible fear determinations consistent with the immigration laws," and ordered the feds "to return to the United States the plaintiffs who were unlawfully deported and to provide them with new credible fear determinations consistent with the immigration laws."
As it happens, Judge Sullivan was all over the administration*'s asylum policies long before Tuesday, when he got famous by taking three feet of skin off Michael Flynn's tail assembly. Famously, last August, when told by government lawyers that a mother and her daughter who had come here seeking asylum were already on their way back to their home country, Sullivan told the lawyers, "Turn that plane around and bring those people back to the United States."

That’s why I suggested he might be an idiot. Not only did he not have all the facts ... but he was railing against Flynn over something that had no relationship to the offense in Flynn’s guilty plea.
And yet, this is the same judge who has given victory after victory to JW FOIA cases. I just don’t get it.
Possibly, he’s the same guy that told Flynn he had sold out his country.
Maybe someone needs to explain to the esteemed Judge Sullivan that the President is tasked with keeping our country safe, duh Border Security.
Not ALL the widdle illegals seeking political asylum are truthful and good guys.
Until the Judge will rake them into HIS personal home, he can go pound sand.
Maybe he has TDS. This administration was just following the law regards asylum. This judge either doesn’t know or doesn’t care.
And the U.S. attorneys meekly asked for this to only apply to the 12 defendants, so they don’t have to bring back all those deported.
I just heard that a deal was made with Mexico for those asylum seekers to stay there until they have a hearing.
I wish the U.S. attorneys, who are supposed to represent the people, would tell him that.
Correction: They are going to get hit with a bit of shock and awe like the world has never seen.
We are now more Rome than we want to admit. Some just need a deep knife or a tight noose.
