You have to think it out, if it is illegal, the courts will overturn it. Maybe that is the plan anyways.
So the President should just ignore the law and the Constitution and wait for the courts to sort it out? That's no way to run a constitutional republic.
Bush took this approach when he signed McCain-Feingold even though he knew it was unconstitutional. And, lo and behold, the Supreme Court let it stand.
If we allow our elected officials to feel at liberty to ignore the Constitution, then it is just a piece of paper.
