The Supreme Court held long ago in Brady v. Maryland that the Constitution requires the prosecution, which holds all the cards in a criminal case, to give the defense all evidence favorable to the defendant, whether it impeaches a witness, mitigates punishment or shows his innocence. Indeed, the burden is on prosecutors to find anything in the possession of the government that is favorable to the defense.

Michael Flynn, which will be decided on Tuesday, he ordered Mueller to provide the defense with all Brady material Last week, Judge Sullivan specifically ordered Mueller to produce any FBI interview reports — called 302s — or memoranda relevant to the original interview of Gen. Flynn. Ironically, Iowa Sen. Chuck Grassley has been requesting the agents’ notes and 302s for two years. Did Mueller comply?

This makes me question Trump’s judgement on this. I know we are probably anxious to get on to the big fight. ANd maybe Trump is right in delaying. But damn...he has plenty on Mueller. The AG should arrest him, but he won’t.
And why? Because prosecutors have it setup so they can’t be convicted. They brief everyone up their chain and then it becomes a finger pointing game or they all attack trump. But that would still be better than what we have now because then it would be fighting over the dirt the DOJ and Hillary created and not the fake stuff they accuse Trump of.

I’m not so sure. Dems are starting to hedge their bets. I read today that Chock full ‘O Schiff is now saying, “even if Mueller finds nothing, we’re going after Trump” (paraphrased). I think Judge Sullivan is about to throw a monkey wrench into Mueller’s world. It won’t fix everything, but it’s a good hefty start.
It’s time for President Trump to order everything declassified, our “friends” in U.K. be damned. When the DOJ and FBI go rogue, and refuse to allow congressional oversight, the CIC needs to step in. Being investigated has hampered his ability to do that without the traitors in Congress try to really hamstring him, but with the House being taken by rats, he may as well go for broke. It’s overdo. And as a side note, Ginsburg needs to retire NOW, if she lives long enough.
Brilliant article. This scandal goes far beyond the Trump investigation. The USG, especially DOJ, FBI, and Intel community have blatantly violated the law and subjected millions of Americans to a massive invasion of their privacy and Constitutional protections. They must be held accountable.

Is Rosenstein a whitehat or blackhat?
I have listened to several of Rosenstein keynote speeches. Have to say . . . he is brilliant, and he knows the constitution better than any others.
Rosenstein position has been from the very beginning . . . under the present and specific circumstance, releasing of the evidence while this investigation is on-going is both un-constitutional and he has warned POTUS can be the trigger for obstruction of justice.
Ain't no lawyer, but when Rosenstein makes his case, it sure sounds convincing to me.
If Rosenstein is a blackhat, then I think we all can agree that while POTUS is awesome in his agenda, he kinda sucks when it comes to appointing some "key" personnel that destroys his agenda.
But yeah . . . we have, we are being played!

I have zero confidence that any such “Brady” rules will be applied impartially.

Trump will be impeached, and probably quick.
He thinks he has cover in the Senate.
However, most of the “Republicans” in the Senate are center/left on many issues, and petrified of getting bad publicity in the left-wing media and press.
Additionally, some are no doubt very concerned about what the deep state could do to them.
As it stands already, it’s the Republicans who have ultimately provided the cover for the sedicious, treasonous, and completely out of control lawlessness being utilized against Trump! And they haven’t done a thing but encourage it all!
Just to show they are “legit” and politically neutral after Trump is fraudulantly impeached by the house, knowing how they have facilitated the treason and lawlessness, Republicans may well block Trump from showing any of the crime filled documents he has!
**Actually, this should be expected. It is the ONLY WAY Senate Republicans can cover themselves with their Republican voters, as they made it happen!
The whole thing is blatantly fraudulant and criminal, but Trump will be impeached soon, and while he will not be removed from office, Senate Republicans cannot allow him to disclose the documents which prove the depth of the fraud and conspiracy, to include their own part in it, including with the Kremlin!
Think ongoing defense of the I fraudulant anti-American process, by prominant Senate Republicans, and how it also included McCain and Moscow.
If they are stopping him, Trumps legal team needs to get out of the way on this, and all docs pertaining to this need to be put out there.
Hopefully I am wrong, but I believe the potential for the Senate to mess Trump up, is worse than many want to believe.
