Sorry, but hush money payments won't send Trump to prison
NY Post ^ | Dec. 13, 2018 | Rich Lowry

Posted on 12/16/2018 6:28:52 AM PST by libstripper

The most legally fraught part of the Russian “collusion” probe now revolves around payments to an American porn star.

As of yet, instead of a dastardly scheme to participate with the Kremlin in the hacking of Democratic emails to subvert the election, prosecutors have uncovered a dastardly scheme to try to keep from the voters — as if they weren’t already aware — that Trump is a womanizer.

* * *

There are major legal obstacles to Trump’s prosecution. One is whether he had the requisite intent of violating the law, and here the standard is very high.

The other is even more fundamental. Bradley Smith, a former chairman of the Federal Election Commission, argues persuasively that the payments don’t constitute campaign contributions.

* * *

In that case [the John Edwards case], two former FEC chairmen said they would have advised Edwards that the payments weren’t campaign expenditures.

The ethics outfit Citizens for Responsibility and Ethics in Washington filed a brief opposing the prosecution [in the Edwards case] and noting some of the same absurdities that the case against Trump raises. If any payments to maintain a candidate’s image are legitimate campaign expenditures, can a candidate who wants to present himself as a family man pay for child care with campaign funds?

This is a great article showing that the whole "campaign finance law violation" charge against PDJT is unprofessional, frivolous twaddle. Indeed, I do not remember either the NY Times or the Wa Po publishing a serious article refuting the points made here. If anyone reading this post has a citation to either of those publications that refutes what I wrote in the immediately preceding sentence, please post the link.

Like the taxpayer funds used to payoff 270 complaints against Congress Critters?

IIRC, The President told Cohen in one of the defector’s recordings of him to make sure that everything was documented in writing.

Or the $850,000 that Bill “The Rapist” Clinton paid to Paula Jones for exposing himself to her?

If being utter thug criminals in full public view doesn’t send Hillary et al to prison then having done nothing illegal WILL eventually send Trump to jail...because that’s how unimpeded corruption rolls.

“...as if they weren’t already aware — that Trump is a womanizer.”

Why should I believe that he is a womanizer? The Leftist media lies about Trump so reliably that it’s a safe bet to assume the opposite of anything they say.

The fact that a billionaire politician pays hush money to a blackmailer proves nothing at all about whether the threatened allegations are true. Nothing. Rich people pay hush money all the time even when there’s no truth to what they are trying to hush up.

The more the lying MSM tells me he was a womanizer, the more convinced I’ll be that he wasn’t.

Period.

This Stormy stuff is silly, so I’m not following too closely, so if I’m wrong, please forgive me.

But here’s how I see it:

1) The election is 1 month out and a bimbo (Stormy) pops up from his past and claims that Trump slept with her. Trump denies it.

2) There is no ‘hard’ evidence to support the claim, such as recordings/videos/pictures, etc. where it’s clear that Trump is admitting to it, or actually doing it, or had done it.

3) Instead all that exists is her word, and probably evidence that it COULD have happened, such as being in the same place at the same time.

4) Now comes the media DOUBLE STANDARD:
a) The media will report her claims as news because they want Trump to lose, and it will be up to Trump to prove it never happened (think Kavanaugh, Thomas, etc.)
b) BUT, had it been Hillary, or Obama, or even Biden, the media reaction would be to REFUSE to run the story unless hard evidence was provided (and even then, who knows if they’d run it), and if it does leak out to the point it is damaging the Democrat, they will all they can to discredit it.

5) Given the above how would ANYONE react, in that situation, or Trump or a Democrat.
a) If Trump, you have to keep the report from ever coming out in the first place due to the damage it will do, and you know that the media will put it out there, as they want you to lose. So you pay hush money.
b) If a Democrat, you don’t worry about it, as you know the media will try as hard as they can to spike it, and if it does get out, they will do all they can to discredit the report. So no need for hush money.

6) So Trump pays the hush money and therefore it implies guilt. He must have had the affair, otherwise why pay it? Go back to #5 for the answer.

And that’s where we are today. Trump is forced to pay out the money, and therefore assumed guilty, because the bias of the MEDIA makes it impossible for him to be presumed innocent, prior to any real evidence showing up. Democrats, on the other hand, don’t have to worry about that crap.

Doubt that? Ask Kavanaugh.

I am trying to find an article I read earlier this year where the author talks with a lawyer who handles very wealthy clients.

That lawyer stated that the amount paid to Stephanie Daniels was what the rich pay out to the lowest level accusers to make them go away. Low level means in most cases the incident never happened and there is no evidence to substantiate the claim. A small amount of money (low six figures) is given to make them go away and keep quiet.

That was the gist of the conversation with that lawyer. She accepted so little (in terms of the wealthy people) because she was just falsely accusing President Trump and it was just easier and cheaper to create an NDA and hand her a small six-digit sum of money.

Hard to understand how Trump’s money could be called campaign donation money, while tax money can be used by congress for such things.

Uranium One has always been the real Russian collusion. POTUS Trump allowing Clinton free and enabling a special counsel to basically go after the President is just insane. The Mueller BS is a farce that is setting a precedent that is destroying the Republic.
