This judge is befuddled. If he can’t see that the “rule of law” is being overturned by his fellow jurists, who refuse to follow the law, he should resign.

I got schooled on this once before:

The policy was officially established by a memorandum from the Secretary of Homeland Security titled "Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children"

This policy allowed certain immigrants to escape deportation and obtain work permits for a period of two years—renewable upon good behavior. To apply, immigrants had to be younger than 31 on June 15, 2012, must have come to the U.S. when they were younger than 16, and must have lived in the U.S. since 2007."

It wasn't an EO by Obongo. This liberal judge was upholding a policy change announced by Janet Napolitano. Her policy change seems to take precedence over the actions of our president?

Liberal, activists judges just make it up as they go....... Now that is a threat to our Constitution IMO.

DACA was an Executive Branch Memorandum. It was not an Executive Order. Executive orders are numbered and recorded in the National Register. It is fake, just like him. If you recall, he claimed he signed it on Air Force One while in Nevada, but it never was recorded.

Greatly appreciated your entry, but the above part is where the questions begin. The term enforcement is not true with anything until it is considered legal by a judge and not the consensus of the citizenry. When judges can stop voted in laws, presidential decisions, and even determine the “possible intent” of a decision with interpretation and not practical fact by themselves, on their own, leaving the actual running of lives and the country in the hands of a select few using taught theologies by unknown and questionable people even to the point of admitting to using foreign based law theology not compatible with our Constitution, then the whole process is in line for failure every time. This is how countries fold. I believe it’s in a song, “you can’t even run your life, so I’ll be damned if you’ll run mine.” But there are clauses for that, also, and unfortunately.

At the present time, there is no Rule of Law in the United States of America. And until the members of the Clinton Crime Family have been held accountable for their crimes and actions, there will be no Rule of Law.

Granted, there is a court system, but its purpose is to control the serfs and peasants and take care of the Elite's enemies.

Independence?

I’m sorry, Your Honor, but have you read the constitution? You are not independent in the slightest bit. You are selected by a president, you are confirmed by the senate, and subject to the oversight by the House which can move the Senate to eject you.

There is no judicial independence in the constitution. There was never intended the slightest independence; you are functionaries who are fulfilling a very simple function, dispensing the laws created by the legislature and enforced by the executive.

What is at threat at this time, especially since more and more people are starting to clearly see, is the constant attempts to elevate (and maintain) the judiciary as some sort of super government which can not only dismiss laws at whim, but also can make new ones as they please (if that’s not clear, see SCOTUS creating gay marriage in the US.)

Too bad Congress won't kick out judges, like those in the 9th circuit.

Oh, the irony. The Constitution is ALREADY largely a dead letter, or at least a very warped letter, because judges like Bates think they are independent of the text of the Constitution and feel free to read into it their own policy preferences and moral views.

That’s exactly right. For over 100 years they have abandoned the Constitution. That is what is destroying the rule of law, legislation by judicial fiat. Methinks this judge protests too much.
