This goes to the 5th Circuit Appeals now, probably will be stayed but could be heading soon to the Supreme Court again. I don’t see a different result. Roberts has turned even more left since Trump got in. Probably will join the liberals 5-4.

Roberts declared it a tax. Tax was removed.

Roberts was the one that said it was a tax. So if their is no tax, he has no grounds.

Roberts can’t. He ruled that it was a tax.. Congress repealed the mandate, which was the source of the tax.

Roberts is hoisted by his own petard.

I think that the logic of Roberts’ prior opinion upholding Obamacare will more or less require him and the Court to strike it down. This will prove extremely awkward for the Democrats because they will then have to negotiate a compromise replacement plan with Trump and the GOP in Congress, but it is probably the best outcome for Roberts and the Supreme Court in that both political parties will have tacitly accepted the reasoning of Roberts’ prior opinion. Historically, that is how many controversial Supreme Court rulings become settled law.

Both Roberts and Kavanaugh refused to hear a case against Planned Parenthood. Since only 3 justices voted to hear the case it will not be heard as 4 votes are needed.

If it turns out that a lot of people really want this health care, then reinstating a penalty of $1 for those who don’t sign up could solve the tax or non-tax issue.

Didn’t Roberts declare some way or the other that it was a tax after Obama said it was not a tax and it being a tax was how Roberts justified it being passed and him voting for it, or something along those lines. He will not vote against what he said it was. Your are right about him going with the libs here.
