U.S. District Judge Reed OConnor agreed with 19 States to declare the Affordable Care Act, (aka Obamacare) Unconstitutional because Congress revoked the tax penalty last year.

Bitch away, traitor Roberts.
Yes, the problem will be what next. Is all insurance invalid? Will everyone be out of insurance at end of the month? There really are not standby alternatives. You can be sure that Republicans will get the blame for the mess. Congress definitely owns this because they should have legislatively repealed and replaced it in an orderly manner, not this impending mess. Bet congress never anticipated it getting ruled unconstitutional, thus caught flatfooted. I’m happy it’s gone, or would seem to be, but a replacement cannot be rolled out in two weeks.
I don’t see how you reach that conclusion with Kavanaugh. The ruling he sided with was use of federal funds, or restrictions on their use by a state. This was not a ruling on abortion, which is why the ruling came and went without much excitement.
Sure they will. These plans are incredibly overpriced and inflated. Remove government subsidies since the whole thing is unconstitutional, then people have to pay several thousand a month for plans. The non-exchange plans are even more expensive. The insurance companies used the tax money as way to inflate the prices of these plans.
The Rats can complain about ‘activist judges’ ...but a Constitutionalist would ask the question....where in the Constitution does it grant the federal government to 1) deal with health care in any fashion and 2) tell people what they can and can’t do regarding health care? Per thee 9th and 10th Amendments - the Federal government should have NOTHING to do with health care...and it should have been declared unConstitutional - from the very beginning.
>> Many of the (somewhere around) seventeen million people
Bullshit numbers.
Dirtbag Obama terminated my decent health care policy effectively forcing my family onto the crap ACA the creepy bastard signed into law. And then the creepy bastard claimed that he saved my family by including us among the ‘seventeen million.’
That lying dirtbag took away our family doctor and the kids’ pediatrician. That lying dirtbag took away my local clinics. That lying dirtbag took away our phenomenal hospital. And that lying POS jacked my out-of-pocket by $10k annually.
And never wish ill-will on others, and I won’t wish it on Obama and the Democrat Thug Party, but Hell it’s tempting.
“Will companies, can they, offer plans for January 1? Can they do so with all the regulatory red-tape? Bet this becomes topic 1 this weekend. Maybe an appeals court or Supreme Court will stay this until what next is figured out? Surely folks are ready for this day?!”
The timing on this decision is interesting, since as you say deadlines are approaching. Perhaps this is the way the fast track to the Supreme Court.
Nuh-uh. Lefties like it. I knew some back in the Obamacare days who were solidly middle class who found ways to get their doctor appts for free by being dishonest about their income (self-employed people).
“Many of the (somewhere around) seventeen million people who will lose their insurance if this decision is upheld will not be in a hurry to vote red any time soon.”
So we should be like the dents and by votes by giving people free handouts? Only those getting the cost-sharing subsidies like Obamacare. The rest of the people are paying huge premiums, along with the $6,000 deductible. I don’t think they will miss this insurance.
The best way to access healthcare in the USA? You go to a doctor, tell him what service you need, and agree upon a price. Pay the doctor what you owe him.
February 2011
Larry ODonnell blames Democrats for rushing the ObamaCare bill to a vote and forgetting to insert the severability clause, but Jonathan Turley isnt buying the post-Florida verdict spin from Capitol Hill. He suggests that Democrats deliberately left out the severability clause as a triple-dog dare to judges. Take out the mandate, the strategy goes, and lose all of the goodies in the rest of the bill! Unfortunately for Democrats, they lost this particular round of chicken.
Lack Of Severability In ObamaCare A Colossal Mistake
Y'all remember WHY the Democrass did not correct the mistake?
Senator Ted Kennedy passed away! Scott Brown takes his place and the Democrats can not sent the bill back to the Senate for another vote!!
Congress did NOT repeal the “tax,” they reduced it to zero.
Roberts will argue that any future congress can raise the rate above zero so therefore the tax is still in effect.
Obamacare will remain the “law” of the land. Count on it.
Indeed. My wife and I have never qualified for the subsidy, and the monthly premium for my family of six, is more than my mortgage payment.
As a consequence, we've never signed up for it, and now pay the penalty instead.
I suspect you are right. Republicans ran on Repeal/Replace, then with power to do so, refused. They have cheered to have ACA thrown out but have done zip to prepare a replacement. I figure because they actually like it as it is.
ACA has inertia and with no free market solution in place, it will simply continue as is. Any problems will get squarely blamed on Republicans. Those in Congress will richly deserve and own the blame as they didn't fix it when they had the chance, didn't prepare replacement.
That type was never going to vote MAGA anyway.
Can’t find a list of the 19 states.
A) Locate doctor.
B) Receive healthcare services.
C) Pay the bill.
Welcome to the free market and Free Republic.
An astute observation, mon freep.
I've maintained all along that the individual mandate needed to be completely excised from Obamacare. Merely reducing the penalty for non compliance to $0 did not do that, so the underlying fact that it's a tax, still remains - levied or not.
Please explain that to our dear president, who is now tweeting about a Republican replacement plan.
“Roberts will probably argue there is still a tax but its $0. So teh tax is still there.”
Actually, for something to exist, its value cannot equal zero. Thus, there is no tax associated with Obamacare.
