The DOJ said that it plans to appeal a temporary restraining order issued last week that blocks the government from categorically denying asylum to those who enter the US between official ports of entry.
Justice Department lawyers... will seek to appeal his order to the 9th US Circuit Court of Appeals and asked him to put his ruling on hold while the appeal is filed. Tigar indicated that he will rule by the end of Friday.... He asked the groups that challenged the asylum policy to file their opposition by Thursday.
Tigar's order, government lawyers argued, "directly undermines the President's determination that an immediate temporary suspension of entry between ports of entry is necessary to address the ongoing and increasing crisis facing our immigration system."...[snip]
"Our asylum system is broken, it's being abused by tens of thousands of meritless claims every year. ... It is absurd that a set of advocacy groups can be found to have standing to sue to stop the entire federal government from acting so that illegal aliens can receive a government benefit to which they are not entitled," Homeland Security....[spokespersons] .
They argued that the President has the right to suspend entry by individuals... he determines it to be in the national interest.
"As the Supreme Court affirmed this summer, Congress has given the President broad authority to limit or even stop the entry of aliens into this country. Further, asylum is a discretionary benefit given by the Executive Branch only when legal conditions are met and a favorable exercise of discretion is warranted," Waldman and Stafford said in their statement. "It is lawful and appropriate that this discretionary benefit not be given to those who violate a lawful and tailored presidential proclamation aimed at controlling immigration in the national interest."

They should have announced that they were ignoring the order until the SCOTUS makes a ruling.
This is one of the first signs that Jeff (Rip-Van) Sessions is no longer in the driver’s seat. Our Justice Dept. is not going to let that judicial block go unchallenged. Good!!

Trump has already said (correctly) that the 9th Circus is going to support the Obama judge.
This is on a slow roll to SCOTUS.
It should be illegal to entertain asylum claims of people who have just committed a felony.
Jeff would be just ‘yawning’ about now. What a huge disappointment.
But,
Why wasn’t the DoJ paperwork at the ready, waiting for some 9th Circus freak judge to rear his ugly head?
They KNEW that at least one stop was coming and Trump’s response should have been filed within 24 hours of Tigar’s ruling.

As usual we lose. All of Government is useless in keeping America as a Country. Why do criminals always win when it comes to Government?
That’s what I think about too.
The white house lawyers had to know a challenge was coming.
Why not whip the response out immediately?
No need to wait two weeks and cobble something together.
That is an area I hope they get better at. Asap.
Perhaps the legal team is rather small and somewhat overwhelmed at the totality of challenges. Maybe that’s what’s going on.
It doesn’t help any that dear potus just reamed J. Roberts; not that he didn’t wholly deserve it.
Certainly, he’s not dragging it out hoping RBG will croak. By the time she is replaced it would be many months past her expiration date.
Why are they even discussing THE NEED TO ADDRESS THIS?
It is capitulating and acknowledgement that the 9th even has the right to have branding irons in the fire.
Hopefully I am not the only one who is getting sick of the idea that a back up law needs to be passed to make a prior existing constitutional amendment the law of the land. This gives them power that they DO NOT HAVE.
They are forcing us to double look at something that is already set in stone. Why are we now falling for this? We need to stop them in their tracks right away without guilt or question and stick to it.
