A federal judge temporarily blocked the Trump administration from denying asylum to migrants who illegally cross into the United States, saying the policy likely violated federal law on asylum eligibility.

The judge pointedly denied the claim that the president, by fiat, could give the manner of entry added legal weight as a determinant of asylum. He reasoned that the

Three co-equal branches of the Federal government should be the Legislative (Congress), Administrative (headed by the President) and Judicial (Supreme Court).

Not according to Occasional Cortex. It’s the house, the senate, and the executive.

So all it takes is one judge, someone who may never have been elected to anything, to completely paralyze a president? This can’t be what the Framers had in mind. It’s gotta stop.

But first, we’ll have to determine just who is the migrant and who is the invader. It may take a long time to “prove” each person.

He can ignore it, just like the Judge ignored his executive order, on an emergency basis and tell the judge that the SC will sort it out. I am sure he will be advised of that.

Immigration law is very clear...it gives the President authority to deny entry to ANYONE...at least that is my understanding. And no, the United Nations does not have superior authority. At some point, Trump needs to simply tell the judges to **** off.

Stopping these petty federal judges from declaring authority over the POTUS, or nationwide, should be a top priority for the lame duck congress. Otherwise, President Trump’s next two years will be as handicapped by these radicals as were his first two.

Yes he can. He will have to rewrite some of the provision (move some words around) and reissue the order. It will be a continuing game until it hits SCOTUS.

Did the judge cite the exact language in the law where Congress expressly forbids what Trump has done? Or is it just in his interpretation?

The Supreme Court needs to amend its procedures. Any TRO that bans enforcement of immigration policy must come only from the Supreme Court itself. The appeal process is way too slow and in the meantime, the country is suffering irreparable harm. Robe clad dictators in California and Hawaii cannot be allowed to create the country’s immigration law.

This chit has been going on since Prop 187 was struck down in California back in 1994. Even though 2/3 of the voters approved it. Look how far we’ve slid since then. Head for the hills folks.

Trump needs to ignore these rulings or his Presidency will make absolutely no difference on immigration what so ever. Do not obey these “orders”. The country is lawless and if that’s the case then a real uprising is absolutely justifiable!

I would put a challenge to DACA in front of him today and site his ruling yesterday as the reason DACA is Unconstitutional.

His probable weasel response to deny, would be grounds for the USSC to overrule him immediately. IMO
