Of course, during Buchanan’s term, Confederate forces in Charleston fired on a ship flying the United States flag and did nothing about it. To my knowledge, firing on an unarmed ship on a peaceful mission is an act of war.
When the Confederates fired on Fort Sumter, they committed an act of war. Lincoln did not call for 75,000 volunteers because the Southern States had seceded, he did so because they launched an armed rebellion against the United States.
The Chief Justice cannot repeal the second amendment.
That takes another amendment according to the Constitution of the United States. Enough of the junior high school rhetoric on the subject.
Did the Union warships open fire on Charleston?
It didn’t matter. Davis ordered Beauregard to take the fort by force if necessary before it could be resupplied. The ships were twelve miles off of Charleston when Beauregard opened fire. No one fired on ay Confederate position, not the ships, not the Fort.
Davis fired on Fort Sumter. That is what precipitated the war. Davis’s Secretary of State told him it would be war, but he did it anyway. He would rather have a war than him and his slave holding backers losing money and power.
Your point
I . . . I . . . I thought under the federal supremacy clause of the constitution judges could vote to pass a law if it results in more fairness.
And suppose judges do vote to pass a law to repeal part of the constitution, what are you going to do about it?
Federal judges have a lifetime appointment, don't cha know.
Might try and read the Constitution some day. “what are you going to do about it?” suppose you will run outside with your AR-15, and a few magazines of ammunition to defend your god give rights. Suspect it will read well in your obit.
There was a time when I believed that the people on Free Republic understood the Constitution and the rights of men.
I was mistaken.
Fair enough.
Look around at most of your compatriots and it's clear that they haven't forgiven much less forgotten.
Earlier he wrote:
"If one of the States should declare her independence, your action cannot depend upon the rightfulness of the cause upon which such declaration is based. Whether the retirement of a State from the Union be the exercise of a right reserved in the Constitution or a revolutionary movement, it is certain that you have not in either case the authority to recognize her independence or to absolve her from Federal obligations. Congress or the other States in convention assembled must take such measures as may be necessary and proper. In such an event, I see no course for you but to go straight onward in the path you have hitherto trodden, that is, execute the laws to the extent of the defensive means placed in your hands, and act generally upon the assumption that the present constitutional relations between the States and the Federal Government continue to exist until a new order of things shall be established, either by law or force."
“suppose you will run outside with your AR-15, and a few magazines of ammunition to defend your god give rights. Suspect it will read well in your obit.”
President Trump has graciously pardoned two turkeys this week. I guess now it is my duty to pardon one.
Have a happy Thanksgiving!
“Look around at most of your compatriots and it’s clear that they haven’t forgiven much less forgotten.”
My, my. What a thing to say.
That aside, I hope you and your family have a safe and happy Thanksgiving.
Hope you and your loved ones Thanks Giving is enjoyable. We have much to give thanks for.

I should have realized that you weren't up for a serious discussion but just wanted to indulge in third-rate buffoonery.
You don't have to be a rocket surgeon to follow a money trail as big as this one.
But apparently you need to be a 'rocket surgeon' to come to the conclusions that you have. Which would explain a lot.
The ship, Star of the West, originally civilian, had just been pressed into military service to avoid alarming the Charleston citizenry, and outfitted for battle. It carried 200 troops armed with muskets, war munitions, arms, and supplies for one year.
It was a military expedition force designed to enter a non-Union port and land against local authority.
The Governor of South Carolina had just announced that any attempted improvement in military status by the Union would constitute an act of war.
There is your act of war.
The Union ship's company and 200 troops should have been appreciative that the Charleston citizens and Citadel students let them escape unharmed.
Gona need more than your say so. Cite a source for the claim that the “Star of the West” was carrying troops, arms, and ammunition in addition to provisions.
You just don’t think that you might be ignorant of these events, do you?
