Keep in mind that Whitaker is the acting AG. I believe he can only stay in that position for 90 days before a permanent replacement is named ... and he can't be the permanent replacement, either.

But as an “Acting” isn’t he automatically replaced (if no nominee is yet approved) by the ranking: The Solicitor General.

That will also make Schumer’s head explode.

Keep in mind that Whitaker is the acting AG. I believe he can only stay in that position for 90 days before a permanent replacement is named ... and he can't be the permanent replacement, either. 

He can be recess appointed at the end of December when Congress adjourns sine die, and stay there for a year.
