The concept of first country of asylum (Trump is a Genius)

Introduction: International Standards

The concept of first country of asylum is defined in Article 26 of the APD:

A country can be considered to be a first country of asylum for a particular applicant for asylum if:

(a) s/he has been recognised in that country as a refugee and s/he can still avail him/herself of that protection; or

(b) s/he otherwise enjoys sufficient protection in that country, including benefiting from the principle of non-refoulement; provided that s/he will be re-admitted to that country. In applying the concept of first country of asylum to the particular circumstances of an applicant for asylum Member States may take into account Article 27 (1).

It should be noted that Member States are not required to apply the concept of first country of asylum, as Article 26 is a permissive provision.1

However, in accordance with the APD, those Member States which apply the concept are not required to examine whether an applicant qualifies as a refugee or for subsidiary protection status, where a country which not a Member State is considered as a first country of asylum for the applicant pursuant to Article 26.2

In other words, the Member State may consider such applications as inadmissible.

We are all speculating this is how Trump plans to get around accepting Asylum seekers - presumably his lawyers have advised him

If we had a wall, there’d be no caravan. We wouldn’t have to worry about this in the first place. We wouldn’t have to worry about birthright citizenship either.

Two years in, no wall.

I hate the honorary degree crap! Giving people rewards for showing up! Nothing expresses more what’s wrong with the world then stuff like that!

We would still have a huge problem with birthright citizenship. Visa overstayers make up about half of the illegal immigrants in this country. Visitor, student and work visas are time limited. People simply do not leave when their legal time is up. With today’s internet, our government could know and take care of visa overstayers if they wanted to. Obviously, they don’t want to.

Hopefully PDJT will be explicit in stating that children born to parents in the USA on temporary visas are not entitled to USA citizenship. We have no idea how many visitor visa babies are born every day.

Branding should be a feature of deportations. The problem is that the memory of tattoed concentration camp prisoners has a bad image.

Neverthe less, deprotees should be marked for life

If we had the wall, illegal immigration drops 99% meaning birthright citizens also drop 99%. Is it still a problem? Of course. Would it be as serious an impact to society as it is now? I don’t think so.

How does a wall between the USA and Mexico, which I am completely in favor of, have anything to do with people who come to the USA by airplane with valid visitor etc visas but never leave? They comprise a huge percentage of illegal aliens ( undocumented immigrants) and any of their children born here are citizens.

I hope that PDJT addresses the children born here of foreign parents on temporary visas as well. Some countries, like China, participate in a big scam on us by sending pregnant women here very soon before giving birth so their babies can be American citizens. Then the whole chain migration thing can happen.

Let’s make sure we are on the same level here.

I am not saying birthright citizenship is not a problem. It is.

I AM saying the problem with birthright citizenship is GREATLY exacerbated by the huge numbers of illegals coming thru the southern border.

Fix the southern border with the wall and the problem caused by birthright citizenship decreases dramatically.

Are there others abusing it? Surely. We can fix those problems too but the serious, high priority problem caused by birthright citizenship is fixed by the wall.
