House Speaker Paul Ryan (R-WI) claimed on Tuesday that President Donald Trump cannot end birthright citizenship with an executive order. The outgoing Republican leader made the remarks during a radio interview with Lexington, Kentucky area radio station WVLK.

The issue isn't whether it can be done by executive order. The issue is whether it can be legislated or requires a constitutional amendment. That is what the Supreme Court will ultimately decide. It all turns on what "subject to the jurisdiction [of the United States]" means.
That said, it's good political strategy to keep the issue hot. The caravan is bad for the 'Rats. Being seen to be ready to take emergency action to do something about it is good for the GOP.
For the Speaker to go into the legalities is bad political strategy. Lindsay Graham is helping; Ryan is hurting.

Who the F is Paul Ryan.
Clearly the Trump team’s lawyers have looked at this in depth. Trump is a pretty thorough guy and while he is fast and loose with his comments at times, he is the smartest guy in the room and wouldn’t drop this bomb unless his team had done some homework.

It's not like "birthright" by illegals is constitutional law or any law that congress passed.
A single justice, writing in the minor opinion not related to the issue being judgicated, isn't the way the Founders envisioned laws being made.
