President Trump said in a newly released interview he plans to sign an executive order ending so-called "birthright citizenship" for babies of non-citizens born on U.S. soil.
The policy, which stems from a disputed but long-recognized interpretation of the 14th Amendment, has given rise to what Trump considers abuse of the immigration system. Trump told "Axios on HBO" that the U.S. is the only country in the world "where a person comes in and has a baby, and the baby is essentially a citizen of the United States ... with all of those benefits."

The 14th amendment was never intended to grant citizenship to kids of illegal aliens.
The amendment, IIRC, was added by Republicans in the 19th century because Democrats were resisting (there is that word again) the common sense notion that freed slaves and their babies were indeed citizens of these United States.
Original intent must be the lodestar that guides our interpretation.
The author of the 14th amendment, Howard Jacob, in his own writings made it clear that the amendment was NOT intended to apply to foreigners, so I fail to see why the supreme court would not support this.

The fundamental question at the time was: what do you do with the freed slaves?
Since almost all of them were born here, and there was no corresponding paperwork to address their citizenship here or anywhere else what exactly do you do with them? This was an extension of the "repatriate them" debate. Repatriate them to where? Africa? Where in Africa? Liberia was discussed at the time.
These were honorable Christian men, who understood that to deport them back to Africa was a death sentence for the majority of them and there was no way for them to re-enter the societies they were extracted from.
The idea that an illegal alien can drop a baby here and that child is immediately a citizen entitled to all the benefits thereof is obscene. I will grant conditional citizenship to the children of legal immigrants provided that the legal immigrant completes his citizenship within a specified time. This would then be extended to his minor children where appropriate. Were those children to reach the age of majority before that citizenship was granted, the child would be subject to the citizenship process and potential deportation for any failure to complete the process.
Agree. Those born here of legal residents should be granted citizenship.
The 14th amendment should be thrown out entirely.
During reconstruction there was a law passed requiring the former confederate states to ratify the 14th amendment in order to get representation in Congress.
An amendment ratified under that type of duress should not stand.
I am quite sure LEGAL residents waiting for citizenship their births will be granted citizenship!!! ILLEGAL NO WAY!!!

As hard as Axios tries to spin it on their having sprung the question on Trump before he was ready for it, he’s very savvy and knows getting on back onto this immigration issue this week is what will bring home the election — and the House — for the GOP.
