Vietnam War veteran sentenced to 7 years in prison for buying "rare" gun in the 1980

A 70-year-old Texas man was sentenced to more than seven years in prison after pleading guilty to buying an automatic rifle in the 1980s, CBS station KTVT reports. Alfred Pick of Plano purchased the M14 rifle at a gun show that was similar to the weapon he had as an Army lieutenant in the Vietnam War.

"This gun was very rare," Pick attorney Ryne Sandel told KTVT. "You see, at that time it was rare to see one, so he instantly, you know, had a connection to it."

The federal Bureau of Alcohol, Tobacco, Firearms and Explosives raided Pick's house last year on a tip about the weapon, KTVT reports. Two weeks before the raid, his wife of 40 years had died of cancer, according to the station.

Pick and his wife had a gun collection of about 14 weapons, Sandel said. "Many of them were collector's items," he said

This is a tax item. If he paid the tax and registered the gun, no problem.

Having said this, this looks like a thing Trump should be made aware of. Why not just take the gun and let the guy go home? This is NOT justice.

Oh,.... and replace the judge. If the guy was a draft dodging 70 yo, Antifa,( back in the day they called it SDS), throw the book at him. That's why they call it "judging".

Based on the story there doesn’t seem to be much there. Except buying an automatic rifle was even illegal back in the 1980s.

I guess anyone can have one in their basement for thirty years, but my “guess” is he was probably trying to sell it. And selling it, knowing it was illegal will get you in a ton of trouble.

He was wrong, he should have known better.

Kanye West talked to President Trump about prison reform. This would be a good case to advocate for no prison time, and community service.

Seems extremely excessive considering he’s owned it for over 35 years. Had he intended to use it to cause harm, he would have done so long ago. He’s 70. How much of a danger to society is he?

I’m thinking we’re missing something here....

Ownership of Full Auto Machine Guns are governed by two federal laws:

The National Firearms Act passed in 1934

and

the Firearm Owners Protection Act passed in 1986

Bottom line...this guy owned an illegal full auto machine gun.

This article shows that BATFE has zero tolerance regarding illegal full auto machine guns. Penalties are steep and you will be prosecuted.

I can see a vet is more of a threat to society than a murderer.

I’m missing something here even when the auto machine gun’s illegal nature is taken into account.

Its not like the BATF goons had anything better to do with their time.

7 years for this? There has to be more to the story. That seems unusually harsh. No other crime than possession of the weapon with defaced serials? He didn’t brandish it, shoot it, try to sell it? Just had it stored in his house? At age 70 and the crap health care in the prison system, it is almost a death sentence.
