Tucker Carlson’s track record on these things is sketchy. Go back over some of the outlandish claims he’s made in recent months and notice how many of them never panned out.

All Nonsense. Justice Gorsuch was seated on April 10, 2017, well into the Term of the Supreme Court that began on the First Monday of October 2016. He participated in arguments on April 18, 2017 in the case: Ricky Henson, et al., petitioners v. Santander Consumer USA Inc. The case was decided on June 12, 2017. Pay attention class.

Here is what happens:

If no one has been confirmed by October 1, which is beginning to look more and more likely, then the Court will convene with just eight justices, and more importantly, with the conservative and liberal “blocs” on the Court deadlocked with four justices each. Yes, a subsequently confirmed justice can ascend to the bench the moment she or he is cleared by the Senate. But the new justice will typically not vote on cases in which oral arguments were heard in their absence

That’s just not true. He may not be confirmed to take his seat by 10/1, but most certainly he can still be confirmed.

I don’t know what you think you heard Tucker say, but things don’t work that way.

Lewis Powell and William Rehnquist were sworn in January 7, 1972
Clarence Thomas was sworn in October 23, 1991.
Neil Gorsuch was sworn in April 8, 2017.

Justices are sworn in mid term quite often. The court can reset and rehear for reargument cases that were tied prior to a new justice taking office.
