Had me quite concerned as suggesting that his testimony in response to Durbin would suggest how he would decide a new case is clearly outside how he should (and did) comment.
Yes. My point is that the hive mind scanned the decision for who won and who lost, and what Kavenaugh’s position was, saw that it was wrongthink, and stopped. They didn’t read his sound reasoning.
And this is not even the worst of it. By the time something gets to the Supreme Court, the lower courts have reversed each other three or four or more times. These hacks can’t say OMG EXTREMIST OUT OF THE MAINSTREAM when they’re looking at a decision.
