BOISE, Idaho — The U.S. government said an Idaho family is to blame for any injuries it alleges a boy received after he was doused with cyanide by a predator-killing trap that a federal worker mistakenly placed near their home.
Any injuries were caused by the negligence of the parents and child, the U.S. Department of Justice said in documents filed Monday in U.S. District Court, and asked for the family's lawsuit to be dismissed. Mark and Theresa Mansfield of Pocatello sued in June seeking more than $75,000 in damages and more than $75,000 for pain and suffering.
They say their son, Canyon Mansfield, was playing with his dog in March 2017 when the then-14-year-old triggered the trap...

All the ones I’ve seen were clearly marked with 4 flags and signs were posted at every entrance with a warning saying the devices were in use and a picture of the device. I don’t like them and stated so up above but they have been in use since the 1930’s.
They are still in use in some area’s. since this incident back in 2017 they are no longer used in Idaho. I see no use for them at all, a good predator control program works much better and only removes targeted predators.

The government person who placed that trap should be held responsible.
If someone were to place some of these around tbe Department of Interior building and “caught” a few bureaucrats, who would be blamed? The trapper or the poisoned victims?
You know the answer to that.
The test you propose is outstanding. It's essential, I think, to understand the rule and role of law. The law is supposed to "swing both ways," so swapping parties, or putting yourself in one shoe THEN THE OTHER, is a good way to evaluate a rule of law. "What if this was applied to ME?" (or my guy).
The government always gets a break in its own courts. That's just the way it is.
Turn up your sarcasm detector. I thought it was pretty clear that Captain Rhino was attributing that callous disregard for life to the federal government employees who placed the trap.

Imagine if a private company put up something like that with no visible warnings, or maybe a rancher from Nevada. Think of the potential liability, but oh no it’s the federal government where there is no liability for even common sense failure. Forget common law I’m talking about complete disregard of common sense.
In Florida it is illegal to set booby traps on your own property to catch thieves etc... because first responders are put at risk. Coming to think about it it also is why doors are not made burglary proof opening inward instead of outward.

Accidentally placed it near the home of a dog owner? I am relatively certain there needs to be an investigation here....
What agent placed it, what agent ordered the placement? Did they know the family or have any connections?
Like most things in the media the articles about this are hyped for maximum emotional effect. M-44 use is controversial but necessary in my opinion. They’re always clearly signed and it’s clear that the dog set it off since he was killed, the only way for that to happen is that the dog pulled on the device in the manner it was designed to trigger.
Coyotes are a plague and constantly expanding into more of the U.S. It’s impossible to control their numbers by hunting along, anyone that thinks otherwise is fooling themselves. They’re adaptive breeders and very smart, you can get a few by calling but the others in the area will quickly figure it out and cease responding. They wreak havoc on wildlife in an area, many of which have never had coyotes before but do now because we’ve removed their natural enemies. The rabbit population has been crushed in my area and where we used to have a lot of quail 30 years ago, I haven’t seen or heard a covey of quail in years. They kill a huge number of fawns, just last year I killed a coyote about 20 feet behind a spotted fawn that was running full out, he would have had the fawn in another 30 seconds or so if not for my lucky shot. Untold numbers of personal pets that “disappear” from peoples years are surely snatched by coyotes. They’ll get a newborn calf every now and also.
I’m sorry this happened but in the big picture these traps are needed. The USDA like most government agencies has traditionally been run by lefties that are naturally opposed to anything like this but even they admit they’re needed.
No argument there, my friend. I don’t disagree with using the traps, I only disagree with the claim by the government. Hopefully this situation was already investigated thoroughly.
Things also pertinent to this story are: was it rightfully marked? What are the leash laws in the area? Was the dog on a leash at the time?
That’s just the tip of the iceburg, I am sure. Lots of needed unknowns.

I hate having to kill animals but sometimes you must. Snare traps are simply cruel. The live cage traps that you can check at least once a day are the only ones I ever use then if you get a dog or some other animal you don’t want to kill you just release. With these traps the animals might be scared but not harmed until the lead poisoning between their eyes get them and they never know about that.
The worse thing about live traps is when you get a skunk in them. This has happened to me a few times. At first I just tried shooting from a safe distance to down the critter but invariably you end up hitting a piece of the cage doing damage to it. I have found the best way is to walk out to the cage with a sheet held high so the animal can’t see you. you drape the cage with the sheet then using a tiny hole off the critter. They never know what is happening, they get curious but never act afraid and the good part is they don’t spray.
