NBC security analyst and former CIA director John Brennan is doubling down on a threat to sue President Trump after the outspoken former Obama official was stripped of his security clearance.
Brennan appeared Friday night on MSNBC and told Rachel Maddow he is exploring litigation against the president. This follows Reps. Elijah Cummings (D-Md.) and Adam Schiff (D-Calif.) saying Trump stripping Brennan of his security clearance is illegal.
“As you can imagine, a number of lawyers reached out to say that there is a very strong case here, not so much to reclaim mine but to prevent this from happening in the future," Brennan said. "So, I am thinking about what it is that I might want to do. At this time, I’m trying to make sure that the principle is what is going to be defended and supported and this is something that should not be repeated."

This battle is taking facts in the public domain, and making a legal argument that the courts have power of who is entitled to have a security clearance, and who makes that decision.
The notion of taking this to court is absurd as a legal matter. It's nothing more than using legal process for harassment, which the left does with vigor, and the courts like it because it brings them work, revenue; and speaks to their sense of being the keepers of righteous power and judgment..

Discovery in a case that aims to use court power to control Trump's power to grant and remove security clearance can be decided without entering evidence that Brennan was engaged in illegal activities. This is purely a question of court power over an executive function.
Looking in the other direction, Brennan can't use discovery as an excuse to seek motive for the withdrawal or cancellation of security clearance.
Your questions about the politics of all this, and the use of the system to thwart justice (RR using secrecy to protect illegal or unethical conduct by the DOJ/FBI) are well taken. There are ways to get this done. Trump has good people in place to get this done.
Most people want to see things get done the same way Obama and other Democrats do, by breaking rules of sound principle and knocking noggins.

Though honestly, I’m sure this hits hard at the pocketbook in the way of consulting contracts that would be eliminated when they no longer have security clearances. I remember quite a few retirees who made their living off of such consulting long after they left government employment or military service.
But I’m not sure what they imagine their case would be; it is utterly at the sole discretion of the executive if they retain their security clearances. Perhaps the lawyers just want an opportunity to stand before SCOTUS and get shut down.
