You missed the part where the pusher, upon seeing the gun, was retreating before the shooter actually aims and shoots. The jurors would had been alerted to what you missed.

I knew a Deputy Billy Badass such as this shooter. The HOA neighborhood watch commando. Gives a bad name to humans (especially male ones, white ones and gun-owning ones)

That is how I see it as well. This is not a Zimmerman situation, where Zimmerman was on his back and being beaten to death when he fired.

A reasonable jury could decide either way, but that is what juries are for.
