So he could appoint someone already confirmed for something else for 210 days. That's mid-March, two months after the next session begins. It would be an issue that would divide the Republican Party even more than it is now up until the election. There's a good chance that would make it even more possible for the 'pubs to lose control. Then impeachment hearings would begin, further stalling any of the Deplorable Agenda getting implemented.

What a plan that would be!

And then he can appoint that same person for another 210. Or he can pick another of the 50 Senate confirms for 210. Or he can make a recess appointment. Or he can move Rosenstein up if he chooses. He’s not boxed in like so many around here pretend that he is. Federal Vacancies Reform Act of 1998.

There’s no reason that your little tale of woe has to play out the way that you wrote it. The GOP can approve the guy that Trump wants.
