No it us not my point of view. But it seems to be a reality. I think it is called “Authority. Resistance or Obedience” There is still choice involved. Make the wrong choice and chances are - you will lose.

Example - 2A says we have the right to bear arms.
So, an attempt is made to breech the capital building check point armed.

Result - HALT OR WE WILL SHOOT!
Is it okay to proceed? If bodily ventilation is the goal... proceed.

Private aircraft cannot overfly certain restricted airspace. Try it sometime. Most of the time the offending aircraft is escorted to a landing site and the pilot is arrested. Don’t comply? There are options, but gas is limited and at some point... somebody is still taken into custody. Usually it is the one without the option of in-flight refueling.

Remember the Cigarette ‘Sin’ Tax was supposed to pay for ALL HEALTH CARE.

Rush had a push on for people to go to the groups of people smoking outside of buildings and THANKING them for paying for your health care.

It came to a screeching halt (NOT THAT IT EVER ‘STARTED’) when ‘inquiring minds’ asked..

“You raise the taxes to discourage people from smoking so you not only will open a ‘black market’ BUT if everyone stops smoking how will you be able to pay the health care bills”

If you want to stop a LIB in their tracks, just present a logical remark to their outrageous claim.

You can see the gears turning and smoking while blank looks fill their faces before they snarl a few choice obscenities at you.

So although something is NOT illegal, it is OK to de facto make it illegal? No, it’s not.

If the public housing residents were doing something illegal inside their residence, yes the public housing authorities could call them on it. Can the law ban public housing residents from smoking in public and common areas, yes. Should they? That is a matter of opinion. Can they ban residents from smoking inside their own residence? They can try, but I think our new batch of Supreme Court justices ought to, and hopefully will throw the ban out.

Indeed. And welfare recipients are definitely in a contractual arrangement with the government.

There are reams of paperwork involved in becoming a welfare recipient” there are signatures on that paperwork which limit what a welfare recipient can and cannot do in order to collect the dole. The same would apply for housing arrangements, especially If they are government owned and operated. As a former Section 8 landlord for one single family home I had to deal with the housing office in the region that the home was located. And every “i” was dotted and every “t” was crossed, and the leasing agreement and contract for the welfare recipient to sign had to be up to a standard that the housing office approved. Contracts had to conform to a pre-approved template, non-compliance resulted in swift eviction. Eviction was not a hurdle the housing office had to worry over as there were plenty of people on the waiting list for almost immediate reoccupancy.

If that much paperwork has been signed and there is a contractually binding agreement established it would be difficult to bring a case to court and succeed.

Means nothing.

Contract clauses are ruled out of bounds by courts all the time. Just because a clause is put in a contract does not mean the clause will hold up in court if it is challenged. I suspect the the supreme court will rule the addition of the “no smoking” rule as an amendment to the public housing “contracts” to be invalid as to its application inside the person’s residence, and stike the ban altogether, suggesting the drafters of the ban revise it to remove any application of it to the interior of someone’s resdidence.

Three to four cigs per day for everyone over 18. Since cigs are taxed so heavily, numbers are likely accurate.
