The New York Police Department (NYPD) reportedly announced that Monday that the police officer accused of choking to death Eric Garner, an unarmed black man, will face a disciplinary hearing.
White NYPD officer Daniel Pantaleo could face dismissal nearly four years after Garners death, the Associated Press reported.
The lawyer for the NYPD criticized the Department of Justice (DOJ) for dragging its feet on whether it will bring about a federal criminal case.
Based on our most recent conversations, it has become clear that a definite date by which time a final decision by the U.S. DOJ will be rendered in this matter cannot be predicted, Lawrence Byrne, NYPDs deputy commissioner for legal matters, wrote to prosecutor Paige Fitzgerald.
Police departments typically hold off on taking disciplinary action until federal prosecutors finish inquiries into possible civil rights violations, the AP noted.
Byrne added that the NYPD could not longer justify putting off disciplinary proceedings.
Pantaleo has reportedly been on desk duty since the fatal incident on July 17, 2017.
Garner, 43, was stopped by police and was accused of selling loose, untaxed cigarettes.
Pantaleo was captured on viral video putting Garner in an apparent chokehold.
Garners gasps I cant breathe, a phrase that has become a rallying cry for Black Lives Matters protests.
Garners family received a $5.9 million wrongful death settlement from the city in 2015.
A police watchdog agency called the Civilian Complain Review Board is set to handle the case, Byrne wrote.

Okay, then what caused the “compression of the neck”? That was cited as one cause of Garner’s death by the Medical Examiner.
I ask that question in all seriousness. What else could cause a compression of the neck besides a chokehold? (I guess a karate chop could do it as well. But I’m sure that wasn’t the case here.)

My comments are not regarding the officer’s actions or the victim’s death (horrible). My comments are directed towards those who think that getting some free money because a loved one was killed is ok, great even.
Suing after a wrongful death is just stringy, gimmee gimmee behaviour. It’s just plain tacky. All the money in Hillary’s campaign fund will not make up for the empty place set at the dinner table.
I’m assuming that the recipients of the ghetto lottery are expecting sympathy from folks. Cos, you know, their sonfather/brother was killed. When I read these stories, any sympathy I might have towards the victim’s family evaporates as soon as I see the word “lawsuit”.
I imagine that the amount settled upon is based on lack of future earnings, emotional loss and pain and suffering. Well, I’m here to tell you that pain and suffering is absolutely free!! Emotional loss...well, that too is free. It is endured.
So that leaves me with loss of future earnings. I’m always amazed at how much an “aspiring rap star, junior college student (AS in auto mechanics), or family man” (he stays home while the wife works) is actually worth.
And I wonder at the sleazy lawyers who take these cases. They must do it on a contingency basis, with the lawyer getting at least a third. So, the lawyer has a personal vested interest in getting the highest amount. Tacky.
I’m sorry, I don’t know what came over me. I just really felt the need to share the scorn with which I view these lawsuits. Interesting how a city/defendant can come up with 5 million bucks, but they can’t afford to buy body cams for the cops.

The police officer wouldn’t have survived the grand jury if he had put Garner in a chokehold. He used a take down maneuver that he was taught during training.
Yes jump on a guys back and wrap your arms around his neck because hes selling cigarettes and simply has the gall to ask you why you are hassling him.
Garner resisted arrest. The police officer used a take down technique taught in training. His arm was placed on Garner’s upper chest not across his neck. Garner then forced himself and the officer into a plate glass window that almost broke. At that point his arm may have gotten close to the neck, but that was an involuntary reaction to what Garner did.
If this wasn’t the case the officer never would have made it past the grand jury.
Plenty of articles about the violation of policy back when this happened.
You believe a man selling lose cigarettes and having the gall to simply object verbally to you hassling him deserves you jumping on his back and wrapping your arms around his throat and dragging him to the ground?

That’s a good question. And one that hasn’t been answered, as far as I can tell. Perhaps the ME saw significant bruising on the neck, bruising consistent with a chokehold.

Why,when there were 4 cops present? A man on each extremity, up over and prone, cuffs go on, into wagon he goes. Might take 30 or 40 seconds. I once heard a cop brag of the effectiveness of this.
4 cops and a supervisor (a sgt I believe) on scene for a violation slightly more serious than spitting on the sidewalk. I suppose NYC has no real crime these guys could have been dealing with.
he "resisted" by simply moving his arm when 1 of the cops tried to take him by the wrist to cuff him, then he was jumped from behind. he presented no threat in any way, shape or form at the time he was jumped. and he was jumped.
this situation was escalated out of control by the amateurish and incompetent behavior of the cops here. the sgt should have been fired. he completely mis-handled this. another example of public-sector employees not being held accountable for actions that private-sector employees get fired for.

Anyone,of any color,is stupid to physically resist...or even mouth off...when confronted by the police.Anyone,of any color,who feels that the police are mistreating them in any way should obey all of the cop's instructions and,while doing so,should calmly yet clearly say to the cop something like "You're treating me unfairly/illegally.When the dust has settled here I will own you *and* your employer".
