The New York Police Department (NYPD) reportedly announced that Monday that the police officer accused of choking to death Eric Garner, an unarmed black man, will face a disciplinary hearing.
White NYPD officer Daniel Pantaleo could face dismissal nearly four years after Garners death, the Associated Press reported.
The lawyer for the NYPD criticized the Department of Justice (DOJ) for dragging its feet on whether it will bring about a federal criminal case.
Based on our most recent conversations, it has become clear that a definite date by which time a final decision by the U.S. DOJ will be rendered in this matter cannot be predicted, Lawrence Byrne, NYPDs deputy commissioner for legal matters, wrote to prosecutor Paige Fitzgerald.
Police departments typically hold off on taking disciplinary action until federal prosecutors finish inquiries into possible civil rights violations, the AP noted.
Byrne added that the NYPD could not longer justify putting off disciplinary proceedings.
Pantaleo has reportedly been on desk duty since the fatal incident on July 17, 2017.
Garner, 43, was stopped by police and was accused of selling loose, untaxed cigarettes.
Pantaleo was captured on viral video putting Garner in an apparent chokehold.

Garners family received a $5.9 million wrongful death settlement from the city in 2015.
A police watchdog agency called the Civilian Complain Review Board is set to handle the case, Byrne wrote.

Crap like this incident are what fuel the crap that the BLM and others.
Some cops do bad or wrong things, and when they do they should be dealt with... fact 4 years and still not dealt with, is shameful.
They had to kill him for selling loose cigarettes.
He was standing outside a small business that was paying taxes on cigarettes. They called the cops on him. He resisted the cops and died.

No, they had to kill him because he resisted to the point where the force applied was more than his medical condition could take. That can happen with any law on the books.

Get after politicians who want to pass nuisance laws because they can’t bear the heat of raising taxes.
The police are not at fault in this situation.
There is something both sad and beautiful about what Garner was doing. He was a free man in America engaging in capitalism at its humblest level. So they killed him.

The New York City Medical Examiner’s Office report stated “Cause of Death: Compression of neck, compression of chest and prone positioning during physical restraint by police” and “Contributing Conditions: “Acute and chronic bronchial asthma; Obesity; Hypertensive cardiovascular disease”.
Garner’s poor physical condition contributed to his death. But the NYPD prohibits the use of chokeholds. And that’s exactly what a “compression of neck” is.
So at a minimum, the cops involved violated policy. They should be fired for that alone.
Should they also be subject to criminal prosecution? I’m unsure about that. But one thing’s for certain. No man, even a resisting obese man, should die for selling illegal cigarettes.
So are kids selling lemonade on the street.

Every law on the books can result in the death of somebody determined to resist the police. It is how the law is enforced. If you think that is unreasonable, then you have to talk to the politicians that pass nuisance laws because they can’t handle the heat on raising taxes.
The police have no choice in the matter but to enforce the law. Anything less, and you get Baltimore every time.

Here we must disagree. The chokehold is prohibited in the NYPD. So the cops involved must, at a minimum, be fired. And it goes back to what you said. Laws - and regulations - must be enforced to avoid chaos.
And who can say if Garner’s death was inevitable? A chokehold is a nasty thing (I know from personal experience). There has got to be a way for multiple police officers to subdue a resisting man without risking killing him.
Yeah, his medical condition made him surprisingly fragile for such a big guy. If 6 officers had piled on him to bring him down, without the choke, he would have probably died from compression on his chest from those 6 officers.
