Speaking of the assault rap, back when there was a battle about whether there could be laws against burning the American flag (not that long ago; my how things changed quickly), my solution to keep things compatible with the First Amendment was simple. Allow the flag burning, and make the assaulting of anyone doing so punishable as an infraction with a $5 fine and no civil lawsuit allowed.
