Woman sues Chinese buffet for $1M over ‘fried rice syndrome’

A Texas woman filed for $1 million in damages from a Chinese buffet after she allegedly suffered a terrifying bout of “fried rice syndrome.”

Germaine Mobley, 62, said went to Asian King Buffet in Waxahachie for a lunch in 2016 that left her gravely ill in an intensive care unit, the Dallas News reported.

Mobley claimed in the lawsuit that she was sickened by Bacillus cereus, also known as “fried rice syndrome,” a type of bacteria often found in foods kept at room temperature.

Mobley said she ordered fried rice at the restaurant and began to feel sick during the drive home.

...

Mobley, who had pre-existing health conditions, went to the hospital the following day when her health continued to deteriorate, according to the news station.

“I just started vomiting,” she told WFMY. “The next morning, I was having problems breathing, so my husband called an ambulance.”

Asian King Buffet’s owner has denied Mobley’s allegations that its food made her sick, WFMY reported.

I had lunch at a decent Chinese buffet today. When I got my bill, the girl said cash only. Internet was down.

The bill was $12.50. I only had $8. I told them they could take that and when I returned in a few months, I’ll give them the other four bucks. I was traveling for work and probably won’t be back that way for a while

“Mobley said she ordered fried rice at the restaurant and began to feel sick during the drive home.”

Is she claiming she ordered it ala carte? But why order it if it’s included in the buffet as it’s sure to be? Because if it was the buffet a lot of other folks should have been sick too. My guess is she ate at the buffet but her lawyer realized she needs to say she “ordered” it.

If this woman knew her health was already compromised, then why did she buy food from an open air buffet?
There is such a thing as Assumed Risk.

“Chinese Buffet” - I avoid them as if they all have the plague. They are surely the most profitable and cheapest quality of Chinese food available in most any town a Chinese buffet is in.

http://textbookofbacteriology.net/B.cereus_2.html

EPIDEMIOLOGY

B. cereus food poisoning occurs year-round and is without any particular geographic distribution. The short-incubation form is most often associated with rice dishes that have been cooked and then held at warm temperatures for several hours. It is often associated with Mexican and Chinese restaurants, but in one reported outbreak, macaroni and cheese made from powdered milk turned out to be the source of the bacterium. “Mac and cheese”- you can’t get much more American than that.

Oh come on! Eating at a Chinese buffet and playing Russian roulette with the shrimp is what makes it an adventure!

Good restaurants check the temp of foods on buffets. Hospitals always do in their cafeterias. This woman should win because she landed in ICU, probably septic, and the buffet should have kept the temps safe for diners. As long as she didn’t leave leftovers at home on the counter and sicken herself, that is.

My mom and dad loved buffets, especially the Chinese variety. I avoid them at all costs. The food is just gross to me, and I like Chinese food.
We have a very small mom and pop shop about a mile down the road from us. I go there about twice a month to pick up food. They always make my food fresh and are as nice as can be.

It is generally a good rule of thumb not to go to a Chinese buffet in between lunch and dinner, from about 2:30 til they start charging dinner prices.

The same unwritten rule most certainly applies to refried beans and Mexican Restaurants else it could easily end in a pesky case of listeria and an afternoon spent on the throne attached to a huge roll of toilet paper.
