The Supreme Court ruled Wednesday that pubic sector unions for state and local employees cant force non-members to pay a fair-share union fee.
In a 5-4 ruling Tuesday, the court said the extraction of agency fees from non-consenting public sector employees violates the First Amendment.
The case centers on an Illinois law, similar to those in 22 other states, that allow public-sector unions to collect a fair-share fee from employees for non-political activities like collective bargaining, regardless of whether those employees belong to the union or not. Mark Janus, a state child support specialist at the center of the case, argued against having to give up about $45 from each paycheck to the American Federation of State, County and Municipal Employees (AFSCME) Council 31. Doing so, he said, violates his First Amendment rights because it forces him to support the unions messaging.
The union, AFSCME, argues it needs the fair-share funds to offset the significant costs it incurs negotiating working conditions for all employees. State laws allowing unions to collect these fees are justified, the union said, to avoid a situation where nonunion members get a "free ride."
A group of 15 public sector unions, warned the court in a friend of the court brief that eliminating fair-share fees would eviscerate public sector unions, depriving them of resources they need to perform their essential public functions.
The elimination of fair-share fees would create an all-or-nothing choice for the workers whom unions represent: pay union dues or pay nothing but still receive the benefits a union provides, they wrote.
In that world, many rational employees will choose to become free riders.

My state of Ca is completely owned by the unions
It means that the thugs will have to come out and intimidate openly now. They won’t be able to rely on the government to be their enforcers. This means that you can expect some major violence against those who will not pay their dues or “tributes” to the Union.
Public unions mostly came about after WWII when cities took over the bankrupt mass transit agencies. The mass transit workers were already in railroad unions. Prior to WWII only Police and Fire had unions. Once the mass transit unions infiltrated the government they recruited more departments to join the union.
“The number of employed union members has declined by 2.9 million since 1983. During the same time, the number of all wage and salary workers grew from 88.3 million to 133.7 million. Consequently, the union membership rate was 20.1 percent in 1983 and declined to 11.1 percent in 2015.”
No doubt that he was in danger and he had to know it, he’s a man of real courage.

“Supreme Court rules in favor of non-union workers who are now, as an example, able to support a candidate of his or her choice without having those who control the Union deciding for them. Big loss for the coffers of the Democrats!”
Good to know. Color me incented. Thanks!
‘Tis a glorious day to be alive!! Viva SCOTUS!!
Why don’t they have to pay back the money they stole from non-members?
Thanks for posting that.
Love the way President Trump speaks out. MAGA!
Is this technically the case, that federal unions were only legalized via executive orders? If so, I would think some form of executive order could start to unwind them as well? Certainly, that is as needed as overall civil service reform, and I would take it there are not unrelated.
It will have impact. Taxpayers pay the public employees wages and lavish benefits. The PEUs elect democrats, who give them everything they want in return, and raise taxes to pay for it.
Private labor unions actually have to at least be somewhat reasonable in their demands, as they work for a business that has to make a profit with willing customers.
I keep hearing that Kennedy is retiring. We can hope.
Ginsturd is dead already, they just wheel her body in when needed.
Sotomanure is also having health issues. I can dream of Trump picking 3 more judges before 2024.
Forced membership + Forced dues = Involuntary Servitude
Hope he watches his back.
Yup - a strong case exists for private sector unions.
Public. sector unions are little more than an organized auxiliary of the Democratic Party.
The SCOTUS today did away the fiction they primarily serve public servsnts.
Their aim has always to buttress Democrat political power. Thats gone now.
