Rosenstein threatened to 'subpoena' GOP-led committee in 'chilling' clash over records, emails show

Deputy Attorney General Rod Rosenstein threatened to “subpoena” emails, phone records and other documents from lawmakers and staff on a Republican-led House committee during a tense meeting earlier this year, according to emails reviewed by Fox News documenting the encounter and reflecting what aides described as a "personal attack."

The emails memorialized a January 2018 closed-door meeting involving senior FBI and Justice Department officials as well as members of the House Intelligence Committee. The account claimed Rosenstein threatened to turn the tables on the committee's inquiries regarding the Russia probe.

“The DAG [Deputy Attorney General Rosenstein] criticized the Committee for sending our requests in writing and was further critical of the Committee’s request to have DOJ/FBI do the same when responding,” the committee's then-senior counsel for counterterrorism Kash Patel wrote to the House Office of General Counsel. “Going so far as to say that if the Committee likes being litigators, then ‘we [DOJ] too [are] litigators, and we will subpoena your records and your emails,’ referring to HPSCI [House Permanent Select Committee on Intelligence] and Congress overall.”

President Trump has lent the seditious plotters all the rope they need to hang themselves. Rod Rosenstein is not the big fish, so I'm not worried about immediate arrests; the net will get them all when it closes.

In the end it will be interesting to see who were the "cooperating witnesses." My money says Lisa Page and Peter Strzok sang like birds when confronted with their mountain of incriminating texts, and I'm sure there are more...

The Great Donaldus Magnus will wait until the time is right, when he knows public opinion will support him, and then drop the Hammer of Thor on these ass-clowns. Sessions is waiting in the wings with the smirk of the hangman.

The histories of both men suggest that you are right. President Trump always plays the long game to get the whole enchilada, not settling for little pieces. And Sessions's 16 years as a federal prosecutor shows a cunning player who knows how to keep his mouth shut while taking down a large scale conspiracy (he destroyed the KKK in Alabama, in case nobody here remembers). Time will tell...

At thi9s point, the Speaker should have signed a WARRANT for their Arrests for CONTEMPT OF CONGRESSand given it to the Sergeant at Arms to enforce and JAILED ALL OF THEM in the Congressional Jail.

Simply look up Hinds Precedents, especially chapters 53 and 51, and Cannon’s Precedents, especially chapters 184-185. You’ll find numerous detailed cases of Congress asserting its power, arresting people, holding them until they agreed to answer questions, and then releasing them. Some of these people did not refuse to appear, but simply failed to satisfactorily answer questions. One has to wonder how a previous Congress might have responded to Alberto Gonzales’s endless recitations of “I do not recall.”

Congress can Remove the President
Congress can remove the head of every executive agency Congress can remove ALL of their employees
Congress can Abolish every agency they so choose
Congress can remove EVERY JUDGE IN AMERICA, including every supreme court justice.
Congress can abolish every federal court except the supreme Court
Congress can decide which cases the Judicial Branch can hear and decide
CONGRESS can Imprison ANYONE they want for any reason they so desire for as long as they wish.
Congress can declare WAR

No other governing body has even 10% of the power CONGRESS has!!

CONGRESS IS ALLOWING ALL OF IT!!!

Congress has the authority to arrest and imprison those found in Contempt. The power extends throughout the United States and is an inherent power (does not depend upon legislated act)

If found in Contempt the person can be arrested under a warrant of the Speaker of the House of Representatives or President of the Senate, by the respective Sergeant at Arms.

Statutory criminal contempt is an alternative to inherent contempt.

Under the inherent contempt power Congress may imprison a person for a specific period of time or an indefinite period of time, except a person imprisoned by the House of Representatives may not be imprisoned beyond adjournment of a session of Congress.

Imprisonment may be coercive or punitive.

There is a very high threshold for a court to uphold a DOJ subpoena of Congress.

It can NEVER be a whole committee. Must be an individual, and the probable cause must be overwhelming.

Rosenstein is cornered and lashing out.

I suspect the IG Report will appear in a heavily redacted form -- redacted by Rosenstein, not by IG Horowitz. If that happens, a trap will have been sprung upon Rosenstein and then Trump will act to release the hidden, incriminating parts. I never, ever assume that President Trump is powerless, and his confident demeanor suggests that something is afoot.

Are you suggesting Congress actually has an enforcement arm?

That’s funny right there. I don’t care who you are.

The jurisdiction of the SAA is limited to inside the Capitol building.

He is a single person.

The Capitol Police provide the real security and they don’t take orders from him. Though they often cooperate, they are not going to physically seize a government official.

Rosenstein has quite the ego. I wonder what would happen if Trump ORDERED him to comply with the Congressional committee’s requests. Lawfully and legally he would have NO CHOICE in the matter, but to comply.

Trump would not do it. No offensive effort by Trump.

I bet within a week if Rottenstien watered down the IG report (scrubbed embassing stuff) his threats to Congress will be refered to the IG for investigation.
