First Amendment paves the road to tolerance in Masterpiece case
The Hill ^ | 06/04/1 | James Gottry

On Monday, the U.S. Supreme Court handed down its ruling in Masterpiece Cakeshop v. Colorado Civil Rights Commission. While the decision ends an almost six-year legal battle, a new journey begins.

This nation stands at the proverbial fork in the road. One path will lead us closer to a society controlled by hostility — one in which those who hold the dominant view in society will use government as a weapon to punish individuals who fail to adopt the prevailing orthodoxy. The other path will move us toward a truly tolerant society — one with room for individuals who believe, speak, and act differently, and one in which government preserves the individual rights of all.

The road we take depends ultimately on whether we embrace the true purpose of the First Amendment. The Supreme Court in its ruling acknowledged the enduring power of the free exercise clause, but left unanswered questions regarding the vitality of the free speech clause.

SNIP

The men who entered Jack’s shop are free to invite his participation in their wedding ceremony; but Jack should be similarly free to decline the offer, without fear of government punishment. No one is forced to agree with either position, but we should all celebrate their freedom to live and work consistent with their beliefs.

The SCCOTUS lefties are in mortal fear of Muslims. It’s the only reason they ruled this way.

Just my opinion.

The dust is beginning to settle for me, and I’m now having very serious reservatations about this purported “win” for Phillips and all Christians.

Leftists are expert at pretending to find for one party, while deceptively building a case for the other. This opinion was absolutely RIFE with language extolling and bolstering “rights” for homosexuals, talking around the “religious freedom” issue to get to their real goal, the ensconcing of a gay agenda. There could almost not be a better case with the effect of enacting an ENDA without the participation of a legislature. This case all but MANDATED that states pass laws “protecting” - actually giving a club to - homosexuals and all their permutations. Read it and see if you don’t see this underlying goal.

Furthermore, it is not at all clear if Jack Phillips may now refuse to serve other sodomites demanding a wedding cake from him. Nor does it set any expectations that other Christian bakers of conscience may do so in Colorado. And believe me, the homo-left WILL be testing it.

From the article - “The fact is, nondiscrimination laws were never meant to compel the creation of art or expression in violation of one’s conscience.”

Should a Christian painter or photographer be required to paint or photograph an act of homosexual sodomy?

Should a Muslim artist be required to depict Allah with a turban made out of a bomb?

Should a homosexual writer be required to write an article supporting the religious condemnation of sodomy and a homosexual lifestyle?

NO I suppose not. SCOTUS (rightfully) chose wisely. Any other decision would open flood gates from hell.

The decision is interesting to read. Kagan’s comments were basically telling the gaystappo how to sin next time.

I’m totally surprised the Shill posted such a reasonable article. They loathe POTUS.

Obiter dicta do not carry the force of law.

Just the same, Trump needs to replace at least one lefty in the USSC to keep this from devolving into an awwwww fest.

And even more — we need to look at what’s going on in the churches. Will churches see the need to launch full outreaches to buggery-holics? They’d be EXCEEDING wise to do so. Jejune railings to “repent” are without any real content when they do not present the Object of said repentance in a credible manner. Will they show they care a hoot about all the other things that focus a life upon sin, or will they treat homosexuality as though it happened in a vacuum? Because if they WON’T care a hoot — the state will give us its version of that.
