Nor does it EXCLUDE investigating or prosecuting. It is unwise, and unprofessional - counterproductive in fact - to announce an ongoing investigation.

AG Sessions avoided saying directly whether or not there was an investigation (or several) underway - but he came as close as possible to doing so. He assured his long time Senate Judiciary Committee colleague Chuck Grassley, that the people and processes were in place, to handle investigation/prosecution, without appointing a Special Prosecutor - that regular prosecutors could handle it (and were).

As Sessions says in the letter “as you know, the Department of Justice cannot provide continuous updates on ongoing investigations, or confirm or deny the existence thereof”

He then states the IG is working on the matters referred by Grassley, and also the FISA applications.

He cites the law, which allows the IG to refer evidence of criminal activity to a US Attoney (DoJ regulations require it, in a timely manner, specifically precluding waiting until a final report). Sessions goes on to say that the US Attorney can then convene a Grand Jury or take other appropriate action.

Sessions states that he has already directed senior federal prosecutors (note the plural) to evaluate the issues raised by the committee. Specifically, he appointed Huber to lead that effort. The additional matters Grassley requested to be investigated were already “within the scope of his existing mandate”.

Bottom Line: Sessions assured Grassley that ALL the issues he raised (and more) had been assigned to well qualified and well resourced investigative and prosecutorial professionals. Essentially, he confirmed a whole task force of prosecutors, led by Huber.

Sure, Huber could recommend new investigations, or a Special Prosecutor, but he is duty bound to investigate evidence of criminal activity (and there are mountains of it) - he has explicitly been given a specific non-geographic mandate. The IG would be professionally liable if he had not referred newly uncovered evidence in a timely manner, as it was discovered.

When the IG issues his report, Huber and his team will be responsible for having investigated and having prepared to prosecute those criminal activities contained within.

Here is the letter, try to pick out the pertinent facts (resources assigned, all allegations being handled), and don’t get distracted by ancillary additional review or recommendations. Multiple prosecutors have been assigned - and have been working for some time already.

At your request I have re read the AGs letter. I note that in two places, including his concluding paragraph (third from the end) Sessions specifically repeats that Mr Huber has 3 charges. They do not include anything beyond “ making recommendations to the Attorney General”. This language would NOT have been used if in fact Sessions intended that Huber have normal US Attorney discretion ( which does not require AG approval to conduct investigations and file charges.)

I understand your feeling that, taken as a whole, the letter seems to suggest thar Grassleys concerns are being addressed. In one sense they are because they are being examined by the Dept IG who has the ability to refer alleged crimes to the appropriate US Atty. But, and it is a big But, what sessions has done is not the same as either appointing A Special Counsel or referring to a US Atty with instructions to investigate and take whatever action is appropriate. Instead he has ordered an INTERNAL DOJ REVIEW, the purpose of which is different than a crimnal investigation.

Having mr huber work with the IG is not the same as him being assigned to file criminal charges.

So what is going on with Huber is that he is one whom has already been confirmed by the Senate. AND, reportedly, he is a crack prosecutor against RICO targets.

That in itself is key.

The Left will confirm no one who is not anti-Trump, so Huber works for us, hopefully.

Same with appointing a second Special Counsel. The Left will confirm no one who is not anti-Trump.

Shocking is that the quiet one is the ARKANSAS federal investigator working on URANIUM ONE and the Clinton Foundation ties are wrapped up in that investigation.

Jury is out on what hell that ARKANSAS prosecutor may rain down on the abuse of power and RICO charges against the Clinton Machine, connected to the Obama federal intel machine against Trump.
