He can resign, but he already is privy to a lot of information that is covered under lawyer-client privilege. That basically prevents him from taking another position as an attorney where he has to represent someone else's interests that might potentially conflict with Trump's interests.

If you hired a lawyer in a civil lawsuit, would you be OK if he left his firm halfway through the trial and showed up in court a few days later representing the other side in the lawsuit?

I’m not following you about “the other side.” Rudy would be investigating the DOJ/FBI, not representing them.
