California asks judge to toss out Trump admin suit over sanctuary laws

California has asked a judge to dismiss the Trump administration's lawsuit concerning the state’s sanctuary laws that protect immigrants in the country illegally, Bloomberg reported.

According to a court filing from Friday, California is arguing that its targeted laws “are consistent with the federal constitutional and legislative framework governing immigration enforcement,” Bloomberg reported.

“California’s laws work in concert – not conflict – with federal laws and are fully constitutional,” California Attorney General Xavier Becerra said in a statement. “The 10th Amendment of the Constitution gives the people of California, not the Trump administration, the power to decide how we will provide for the public safety and general welfare of our state.”

“The federal government has no grounds to intrude on California’s constitutional authority to enact laws designed to protect its people,” Becerra added.

Federal officials filed a lawsuit in March saying that the California legislature passed three laws that violated federal immigration law and the Constitution’s supremacy clause that gives federal laws primacy over state laws.

California’s laws are designed to allow local law enforcement and business owners not to cooperate with federal agents on detainer requests. It also created a state inspection program to monitor federal detention centers and bars California police and sheriffs from asking about a detainee’s immigration status.

Becerra said that California's laws do not undermine federal officials’ ability to enforce immigration laws.

The attorney general's office argues that taking down its sanctuary laws would weaken the trust of law enforcement among the immigrant community, reduce workplace productivity and lead to inhumane treatment for people in detention facilities.

I think the black guy on google is a different Judge Ellis, Southern District Magistrate Judge Ronald Ellis.

This is the defendant, William Jefferson, whose picture comes up when you search on Judge T.S. Ellis’s name.

No. Please see my recent post. That picture is of one of the defendants who appeared in his court, William Jefferson. Many bloggers jumped the gun & posted the wrong picture which adds to the confusion.

There are many such mismatched pictures because the articles were written quickly and they used the picture of William Jefferson which was associated with Judge Ellis from Jefferson's trial. Fake News at it's finest.

No, that picture posted was of Jefferson who was tried before Ellis. Ellis is white.

Google Pictures still show a Black T.S. Elliot. Rush pointed that out yesterday.

Just checked today they have removed the pictures they had yesterday. Now showing T.S. Eliot the author. Judge T. S. Elliot

Last time I looked, California constituted around 12.5% (roughly) of the national GDP. If California is prime meat for this type of move, then shouldn’t New York, and other places be?

I question the wise nature of lopping off portions of our nation, and our tax base to ‘get even’ with bad players.

It seems better IMO, to remedy the problems with California. Keep it in the fold, and get it back on track.

We don’t want to lop off 12.5% here, and 8.7% there, and 6.9% somewhere else, when it come to our tax base. Sooner or later our national BDP is down by 30% or more, and this makes it hard to meet our financial goals. Those can be military and paying down our debt too.

This doesn’t address California’s excellent warmer water ports, and the rail networks set up to move goods inland either.

Honestly, I think the whole nation would benefit from putting a California governor, state attorney general, and others in prison for a decade or two. This could be extended to the California Legislature.

I'm all for the 10th Amendment and would like SCOTUS enforce it more, but the Constitution clearly gives Congress the power over Naturalization and immigration would be covered either by implication or by the Necessary and Proper Clause. The Supreme Court said as much in Arizona v. United States, 567 U.S. 387 (2012).

Someone needs to remind Becerra that he can’t have it both ways...in concert - no conflict with federal laws. If that’s true then why is he arguing that CA has the right/power to decide how to provide for citizen safety? Why is he complaining if CA is in compliance with federal law? This jerk should have stayed in the U. S. Congress. He’s too dangerous for CA to have in state office.
