Iowa passes 'fetal heartbeat' abortion ban, most restrictive in U.S.

(Reuters) - Iowa’s Republican-controlled legislature passed the most restrictive abortion ban in the United States on Wednesday, outlawing the procedure after a fetal heartbeat is detected, often at six weeks and before a woman realizes she is pregnant.

The Senate voted 29-17 to pass the House of Representatives-approved bill, according to the legislature’s online voting tallies. The bill now goes to Republican Governor Kim Reynolds, an abortion opponent, who has not said publicly whether she will sign it into law.

The legislation is aimed at triggering a challenge to Roe v. Wade, the U.S. Supreme Court’s 1973 landmark decision which established that women have a constitutional right to an abortion, activists on both sides of the issue said.

Abortion opponents aim to land abortion questions back in front of the nation’s top court, where they believe the 5-4 conservative majority could sharply curtail abortion access or ban it outright.

“We created an opportunity to take a run at Roe v. Wade - 100 percent,” said Republican state Senator Rick Bertrand of Sioux City, who said the legislation is designed to be “thrust into the court” that has become more conservative following President Donald Trump’s appointment of Justice Neil Gorsuch.

Spokeswoman Becca Lee of Planned Parenthood of the Heartland, which supports access to abortion, called it an “intentionally unconstitutional ban on 99 percent of safe, legal abortion, designed to challenge Roe v. Wade.”

“The bill weaponizes fetal heartbeat, which is by all accounts an arbitrary standard that bans abortion long before the point of fetal viability,” Lee said in an email to Reuters.

This is actually an excellent “line”. If it has a heart beat, and the heart is human, it is a human life and protected by the constitution.

Before a woman realizes she’s pregnant?????? What kind of nonsense is that!!

Not that it never happens, but most women damn well know they are pregnant by 6 weeks, to say it happens “OFTEN” is bs language manipulation, and biased reporting.

I would bet they pulled that language straight from a planned parenthood press release on the matter.

At best Gorsuch restores where we’d stood with Scalia. At least is Kennedy short of an override and who knows if Roberts can still be blackmailed. I hope this doesn’t get to the Supremes until Trump gets one, ideally two, more picks on the court. But I’m delighted Iowa’s new legislative majority is doing what they’d said they’d do, unlike some post turtles in DC. Gov. Reynolds is doing great so far and her duration record setting predecessor Branstad has to be the unsung hero behind the Nork progress as Ambassador to China and long time friend of Xi’s.

It's good -- it's good --- but I'd push it back still further, on the basis of genetics and early embryology: If it has human DNA, and s it is actuated for totipotent growth, it's a human life and is protected by the Constitution.

"Totipotent" means capable, in the right environment, of growing its own organs and systems.

Thus a skin cell, though it has human DNA, is not capable of growing organs and systems no matter what the environment, hence is not a human being.

But a zygote (or clone or chimera, we'll have to add) with a human genome, which IS capable of growing its own organs, given the right environment, is a human being.

That's not nonsense.

Many women have irregular monthly cycles, and thus don't realize if they've "missed" a cycle until 2 months go past, and sometime more, if they're not particularly paying attention.

The other signs of early pregnancy, such as tiredness, morning nausea, etc. could be mistaken for flu symptoms.

Some women don't gain enough pregnancy-weight to "show" until 4 months.

So yeah, there are actually a not-insigniicant number of women who don't know they're pregnant until 8-10 weeks or later.

That has important implication, e.g. women getting X-rays may unknowingly expose their unborn kids to radiation because they didn't know they're pregnant.

If we had "health" or "sex ed" classes that were actually oriented toward sexual health (and not perversion and gender dysphoria), they'd be training middle-school girls to always keep a calendar of their periods. It should be a life-long habit.

Don’t bet the farm on Gorsuch!

We prolifers have spent far, far too many years hoping this or that SC judge will “see the light” on the issue of life only to find them “growing into the Court’s idea of justice!”

What is hoped for are men and women who love and revere the Declaration of Independence and the Constitution (as well as “caring more for what God thinks of them than men” (and women), especially those at the NYT, the WaPo, the ABA, etc.!)

Can it happen? Yes, is it “often”? Sorry, don’t buy it.

There are plenty of indications of pregnancy that have nothing to do with missed cycles, showing bellies or nausea.

Every woman I have known well, I knew they were pregnant just by looking at them, when they got pregnant, well before they were “showing” in the standard sense, don’t believe for one minute that a large number of women don’t know they are pregnant. By 6 weeks in there are more than enough indicators that a woman is pregnant. I believe there may be some, but the hormonal and physical changes are obvious very very early and If I can notice as just a neaderthal male, I find it very hard that a large swath of women can’t tell from their own bodies.
