First of all, I can’t imagine the hard drives currently in their servers being the same ones as were there 2 years ago. Heck, its doubtful the servers are even the same. It isn’t so much that they’ll lose to the counterclaim as much as if they don’t produce requested items to defendants, they can’t use material from those same items as evidence for their own case.

This is purely a fund raising maneuver and they have no plans of proceeding with this case for many reasons. The defendants’ attorneys should ask the court to sanction the hell out of them. Being in Federal Court, such a motion MAY be successful.

This was one of the worst political ideas I’ve ever heard of. The only reason I can think of that they went through with it was they owed the attorneys involved in the case something.

Exactly. If I’m involved in a car accident and I sue the other driver for permanent injuries, my case isn’t going to go anywhere if I refuse to submit to a medical exam to prove that I’m actually injured.

Not the attorneys, the jury.

They expect a jury trial in DC with a bunch of democrat lovers rendering the verdict.

That's what they did to Scooter Libby.
